09/21/2015 <br />ATTY/RESO.3134/CC RESO APPROVING PLANNED DEVELOPMENT – FINGER RESO. # 15445 <br />REV: 09‐17‐15 VR MUFF # 613 <br />Page 9 of 29 <br />The project as described in the certified EIR included encroachments within <br />the 25’ creek protection setback area (although utilizing a different top of <br />bank location). The EIR analyzed potential environmental impacts <br />associated with the development and provided mitigation measures to <br />minimize potential impacts, to provide enhanced landscaping along the creek <br />where existing impervious coverage will be removed, and to promote a more <br />natural character to the creek. Therefore, the development will not disturb <br />riparian vegetation, but enhance and add to the vegetation along and near <br />the creek top of bank. <br /> <br />(2) The development will maintain the stability of the slopes of the creek bank. <br /> <br />The proposed project includes no work or disturbance of earth within the <br />slopes of the bank. The existing retaining walls located at or near the top of <br />bank would remain in place. Further, the Project would remove existing <br />structures and other impervious coverage that are in close proximity to the <br />top of bank and place new structures and improvements further away from <br />the creek. <br /> <br />The certified EIR concludes that the grading and drainage proposed as part <br />of the project will have a minimal impact on the stability of the creek bank. <br />Further, the installation of fencing along the top of bank was considered <br />within the certified EIR and found to not create an impact on the stability of <br />the creek bank, therefore, the proposed development will maintain the <br />stability of the slopes of the creek bank. <br /> <br />(3) The development will be designed to avoid discharge of pollutants directly to <br />the watercourse and will assure that the discharge of runoff will be filtered <br />over a minimum of twenty-five (25) feet of vegetation or through other <br />equivalent means to the satisfaction of the Engineering and Construction <br />Division. <br /> <br />With the removal of 5,573 square feet of structures and impervious coverage <br />within the 25’ creek protection setback area, and the placement of new <br />structures and impervious coverage further away from the top of bank, a net <br />reduction of runoff into Cordilleras Creek will occur. A minimum of 25 feet of <br />vegetated, pervious ground cover is provided on all lots along the creek. <br />Further, the drainage plan calls for all rooftop runoff as well as all drainage <br />from the rear wall-line of the proposed houses on Lots 1-4 to be treated on- <br />site before being directed and discharged into the City’s stormdrain system <br />located within Finger Avenue. <br /> <br />The certified EIR found that the proposed project represents an improvement <br />over existing conditions as it would reduce the amount of impervious <br />surfaces adjacent to the creek and install a new on-site stormwater system <br />to filter, treat and drain runoff from the project site and direct it to Finger
