Code§27383. <br /> ASSIGNMENT AND AMENDMENT TO DEED OF TRUST, ASSIGNMENT OF RENTS, <br /> SECURITY AGREEMENT AND FIXTURE FILING <br /> (City Center Plaza) <br /> THIS ASSIGNMENT AND AMENDMENT TO DEED OF TRUST, ASSIGNMENT <br /> OF RENTS, SECURITY AGREEMENT AND FIXTURE FILING (the "Amendment") is dated <br /> , 2016, assigns and amends that certain Deed of Trust, Assignment of Rents, <br /> Security Agreement and Fixture Filing which was recorded in the Official Records of San Mateo <br /> County on June 28, 1996 as instrument number 96-079146 (the "Original Deed of Trust" and as <br /> assigned and amended by this Amendment, the "Deed of Trust") and is among Successor <br /> Agency to the Redwood City Redevelopment Agency ("Terminatin�Beneficiary"), the City of <br /> Redwood City, a municipal corporation, as housing successor agency to The Redevelopment <br /> Agency of the City of Redwood City (`Beneficiarv"), Mezes Court Associates, a California <br /> Limited Partnership ("Ori�inal Trustor"), and [New OwrterJ, a California Limited Partnership <br /> ("Trustor"). <br /> RECITALS <br /> A. The Redevelopment Agency of the City of Redwood ("Original BeneficiarX"), the <br /> `Beneficiary" under the Original Deed of Trust, dissolved on February ], 2012, as required by <br /> Assembly Bill Xl 26 signed into law as part of the State of California's budget package on June <br /> 29, 201 l, and its assets and functions, including without limitation its rights under the Original <br /> Deed of Trust, were transferred to the Beneficiary and Terminating Beneficiary. <br /> B. As provided herein: (i) Original Trustor and Trustor wish to assign Original <br /> Trustor's interest in the Original Deed of Trust to Trustor; (ii) Terminating Beneficiary wishes to <br /> acknowledge the termination and release of its interest in the Original Deed of Trust; and (iii) to <br /> assist in the rehabilitation of the Mortgaged Property, Trustor and Beneficiary wish to amend the <br /> Original Deed of Trust. <br /> C.
