1/25/2016 Section 15305, Class 5 of the California Environmental Quality Act (CEQA) Guidelines. Class 5, Minor Alterations in Land Use Limitations, exempts from CEQA the issuance of minor encroachment permits. 2. The City Council of the City of Redwood City hereby continues the City Sidewalk Cafe Pilot Program for a finrelve (12) month period as follows: A. Sidewalk Cafe Permits may be issued in seven (7) locations deemed appropriate by the City Manager/designee, authorizing applicants to extend the sidewalk to replace one or more parking spaces to accommodate the proposed sidewalk cafe. In determining whether a location is appropriate, safety for patrons, pedestrians and traffic, width of the adjacent street, availability of other nearby parking, and aesthetics of the proposal shall be considered. B. Parking spaces utilized for a sidewalk cafe must be directly in front of the applicant's restaurant. C. Installations of sidewalk cafes in parking spaces shall conform to the Sidewalk Cafe Guidelines (attached hereto as Exhibit A), except to the extent necessary to specifically design the installation for the parking space area, and shall be designed and installed only as approved by the City and at the expense of the Permittee. D. Permits for sidewalk cafes issued pursuant to this Program may authorize other exceptions to the Sidewalk Cafe Guidelines only as necessary and appropriate for the new expanded area. E. Except as modified herein, such permits shall be subject to the same fees, guidelines, regulations and conditions of approval as set forth in Chapter 33A for Sidewalk Cafe Permits, provided however that permits issued pursuant to this Program may be effective for the duration of this 12-month Program. F. The City Manager/designee is hereby authorized to continue for the duration of this 12-month program any permits previously issued pursuant to Resolution No. 15340, dated May 12, 2014. 3.
