2/22/2016 <br /> RESOLUTION NO. 15476 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OR REDWOOD <br /> CITY ADOPTING THE MITIGATED NEGATIVE DECLARATION AND <br /> MITIGATION MONITORING AND REPORTING PROGRAM FOR THE <br /> USE OF COPPER TO CONTROL ALGAE AND AQUATIC VEGETATION <br /> IN REDWOOD SHORES LAGOON ALL IN ACCORDANCE WITH THE <br /> REQUIREMENTS OF THE ENVIRONMENTAL QUALITY ACT <br /> WHEREAS, The State Water Resources Control Board released a Statewide <br /> General National Pollutant Discharge Elimination System (NPDES) Permit for the <br /> Discharge of Aquatic Pesticides for Aquatic Weed Control in Waters of the United <br /> States (Permit), and the City of Redwood City ("City") has obtained coverage under this <br /> Permit to apply aquatic pesticides to the Redwood Shores Lagoon; and <br /> WHEREAS, The City desires to use aquatic algaecides and/or aquatic herbicides <br /> containing copper on an "as needed" basis to more efficiently control algae and/or <br /> aquatic vegetation in the Redwood Shores Lagoon. The Policy for Implementation of <br /> Toxics Standards for Inland Surface Waters, Enclosed Bays, and Estuaries in <br /> California, also known as the State Implementation Plan ("SIP") assigns effluent <br /> limitations for California Toxics Rule priority pollutants, including algaecides or aquatic <br /> herbicides that contain copper. The SIP also prohibits discharges of priority pollutants <br /> such as copper in excess of applicable water quality criteria; and <br /> WHEREAS, Although the SIP prohibits the discharge of copper in excess of <br /> applicable water quality criteria into receiving waters, Section 5.3 of the SIP allows for <br /> short-term or seasonal exceptions if determined to be necessary to implement control <br /> measures for resource or pest management (i.e., algae or aquatic vegetation control) <br /> conducted by public entities. The City has determined that it meets the criteria for <br /> gaining a Section 5.3 SIP exception for the use of copper to control algae and aquatic <br /> vegetation in the Redwood Shores Lagoon; and <br /> WHEREAS, Pursuant to this exception and as part of the City's Integrated Pest <br /> Management ("IPM") program, the City proposes to apply aquatic algaecides and/or <br /> aquatic herbicides containing copper on an as needed basis to control algae and/or <br /> Page 1 of 4 <br /> ATTY/RES0.0016/CC RESO LAGOON SPRAYING MND RESO.#15476 <br /> REV:02-11-16 JS MUFF#301 <br />
