11/07/2016 <br /> 1. The recitals set forth above are true and correct, and are hereby <br /> incorporated herein by this reference as if fully set forth in their entirety. <br /> 2. The City Council declares its intention to vacate the public right-of-way <br /> being a portion of Hancock Street, Spruce Street, and Buckeye Street as shown on the <br /> Record of Survey Map No. 2383 in Volume 38, on the basis that it is unnecessary for <br /> present or prospective public purposes. <br /> 3. The City declares that, the vacation will be conditioned upon the reservation <br /> of a Public Utility Easement (PUE), Access Easement, and Stormwater Easement over <br /> the formerly public right of way. <br /> 4. A noticed public hearing on the question of vacating the public right-of-way <br /> being a portion of Hancock Street, Spruce Street, and Buckeye Street, shall be held and <br /> evidence thereon received by the City Council on December 12, 2016. <br /> 5. The public right-of-way being a portion of Hancock Street, Spruce Street, <br /> and Buckeye Street to be vacated is more fully described in Exhibit 1 and Exhibit 2 <br /> attached hereto and by this reference incorporated herein. <br /> 6.
