12/12/2016 <br /> WHEREAS, the City has received and reviewed public comments regarding the <br /> Docktown Plan ; and <br /> WHEREAS, the City has not yet determined its plan for the future use of Docktown <br /> once residential use has been terminated , including whether it will make further changes <br /> to the dock structures and other physical features of Docktown , and the City will consider <br /> whether further environmental review is necessary prior to or at the time that the City <br /> makes such decisions; <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of <br /> Redwood City hereby finds and determines as follows: <br /> 1 . The recitals set forth above are true and correct, and are hereby <br /> incorporated herein by this reference as if fully set forth in their entirety. <br /> 2 . In making its findings , the City Council relied upon and hereby incorporates <br /> by reference all correspondence, staff reports, and other related materials. <br /> 3 . The approval of the Docktown Plan and cessation of residential use at <br /> Docktown is not subject to and is statutorily exempt from CEQA pursuant to Section <br /> 15268 of the CEQA Guidelines, entitled Ministerial Projects . (The CEQA Guidelines are <br /> found at sections 1500 et seq . of Title 14 of the California Code of Regulations. ) The <br /> decision to terminate residential use and to relocate Docktown residents is a ministerial <br /> act under CEQA. Cessation of residential use of Docktown will bring the City's trusteeship <br /> over Docktown into compliance with the statutes granting the City trusteeship over <br /> Docktown and the State's directive regarding the public trust doctrine. The SLC has <br /> unequivocally informed the City that it must cause the cessation of residential use at <br /> Docktown , and the City has no discretion about whether to allow further residential use <br /> at Docktown . <br /> 4 . Even if the City's action were determined not to be ministerial under CEQA, <br /> the decision to approve the Docktown Plan and end residential use at Docktown is <br /> categorically exempt from the requirements of the CEQA because it falls within each of <br /> four classes of projects that the Secretary for Resources has found do not have a <br /> significant effect on the environment pursuant to Sections 15301 , 15304, 15307 , and <br /> 15308 of the CEQA Guidelines, entitled Existing Facilities , Minor Alterations to Land , <br /> Actions by Regulatory Agencies for Protection of Natural Resources , and Actions by <br /> Regulatory Agencies for Protection of the Environment, respectively. <br /> 5 . There is no applicable exception to the foregoing categorical exemptions . <br /> None of the exceptions listed in Section 15300 .2(a)-(f) of the CEQA Guidelines, entitled <br /> Location , Cumulative Impact, Significant Effect, Scenic Highways, Hazardous Waste <br /> ATTY/RES0.0124/CC RESO DOCKTOWN PLAN RESOLUTION NO. 15550 <br /> REV: 12-08-16 VR MUFF NO. 613 <br /> Page 3of5 <br />
