01/09/2017 <br />Exhibit A <br />Article I Section 1.1. "Eligibility for Participation" is amended and restated to read as <br />follows: <br />1.1 Eligibility for Participation <br />Tier I <br />An Eligible Employee shall participate under Tier I in this Plan if he/she is employed as <br />the City Manager, City Attorney, City Clerk, or Department Head Employee of the <br />Employer on or after January 28, 2003. Effective as of August 1, 2005, all Executive <br />Service Personnel Employees have been added to this Eligible Class of Employees. All <br />Eligible Employees under Tier I must be appointed or hired prior to January 1, 2015. <br />2. Article II Section 2.2 "Amount of Employee Contributions' is amended and restated to read <br />as follows: <br />2.2 Amount of Contributions <br />Tier I <br />There is hereby created and established and shall be maintained by the Plan Administrator <br />the Employee Contribution Account. For each day that an Employee remains a Participant under <br />this Plan, the Employee will make mandatory contributions to the Plan as follows: <br />(a) An amount based on a percentage of his or her Compensation or a fixed dollar <br />amount each pay period. The amount of the Employee contribution to the Plan under this <br />section shall be determined exclusively by the Employer and prescribed in Schedule A. <br />No Employee shall have the right to select his or her level of Employee contributions. <br />(b) An amount equal to a percentage of an Employee's unused In -Lieu Hours as of <br />the last day in the last complete pay period in the calendar year multiplied by the <br />Employee's Hourly Pay Rate. The percentage shall be determined exclusively by the <br />Employer and prescribed Schedule A. No Employee shall have the right to select his or <br />her percentage of his or her In -Lieu Hours contributions. <br />Tier II <br />Effective the later of January 1, 2017 or City Council approval, for each day that an <br />Employee remains a Participant under Tier II of this Plan, the Employee will make mandatory <br />contributions to the Plan as follows: <br />The City Manager, City Attorney and Department Heads classified as Public Safety <br />CalPERS Retirement Members or Miscellaneous Tier 3 CalPERS Retirement Members will <br />contribute five percent (5%) of Compensation.
