01/09/2017 <br />WHEREAS, two appeals were filed with the City during the 15 -day appeal period <br />by (1) Carr, Yeley and Associates, and (2) Kris Johnson challenging the Planning <br />Commission's approval of the Project; and <br />WHEREAS, the matter was duly noticed for a de novo public hearing before the <br />City Council on July 25, 2016; and <br />WHEREAS, on July 25, 2016 the City Council conducted a duly noticed de novo <br />public hearing in accordance with all applicable requirements of the Subdivision Map <br />Act and the Redwood City Municipal Code, all applicable requirements of the State <br />Planning and Zoning Law, the City Zoning Ordinance and the Downtown Precise Plan, <br />to consider the appeal of the Project, and received and considered oral and documentary <br />evidence on the appeals and application; and <br />WHEREAS, at the July 25, 2016 duly noticed public hearing, the City Council <br />considered the Initial Study checklist prepared by the City's Planning Division and its <br />findings, the previously certified Downtown Precise Plan Program EIR (State <br />Clearinghouse #2006052027), and the entire record of the administrative <br />proceedings regarding the adoption of the Downtown Precise Plan (including without <br />limitation the Mitigation, Monitoring and Reporting Plan attached to Resolution <br />No. 15086 adopted on January 24, 2011); and <br />WHEREAS, at the conclusion of the July 25, 2016 duly noticed public hearing, <br />the City Council determined that the proposed Downtown Planned Community Permit <br />including five guideline deviations, Tentative Map, Condominium Permit, and Planned <br />Development Permit would further the purposes of and appropriately implement the <br />City of Redwood City General Plan, the Downtown Precise Plan, and applicable <br />provisions of the Subdivision Map Act, the Redwood City Municipal Code and Zoning <br />Ordinance, and adopted City Council Resolution No. 15515 ("Resolution <br />No. 15515") denying the appeals and approving the Project as described therein; <br />and <br />WHEREAS, on August 25, 2016, an association of residents describing <br />themselves as the Redwood City Residents for Responsible Development, of which <br />Kris Johnson is a member and which association is represented by Geoffrey Carr <br />("Petitioners"), filed a Petition for Writ of Mandate against the City of Redwood City, <br />as respondent, and the Applicant, as Real Party -in -Interest, seeking to invalidate <br />Resolution No. 15515, including on the alleged ground that the City Council's <br />approval of the Project did not comply with the Downtown Precise Plan and violated <br />the California Environmental Quality Act, which lawsuit is entitled Redwood City <br />Residents for Responsible Development v. City of Redwood City, San Mateo <br />Superior Court Case No. 16CIV01069 ("Writ Petition"); and <br />ATTY/RESO.0127/CC RESO APPROVING PERMIT FOR 603 JEFFERSON RESO.
