04/03/2017 <br />WHEREAS, on November 1, 2016, the Planning Commission considered an <br />Initial Study checklist and its findings prepared by the City's Planning Division, the <br />previously certified Downtown Precise Plan Program Environmental Impact Report <br />(EIR) (State Clearinghouse #2006052027), the staff reports, oral and written, and <br />testimony and materials presented by all those wishing to be heard on this Project at the <br />noticed public hearing on this matter; and <br />WHEREAS, pursuant to Section 2.0.3.A.2.a of the DTPP (pg. 28), approval <br />authority is vested in the Planning Commission since the development is a "Large <br />Project;" and <br />WHEREAS, on November 1, 2016 and on January 17, 2017, the Planning <br />Commission conducted public hearings in accordance with all applicable requirements <br />of the Subdivision Map Act, and the Redwood City Municipal Code and Zoning <br />Ordinance, to consider the Downtown Planned Community Permit DPC2015-12 <br />including two (2) guideline deviations, Tentative Parcel Map TM2015-09, and the <br />Affordable Housing Plan, along with all applicable requirements of the State Planning <br />and Zoning Law, the Downtown Precise Plan, and the recommendations of the AAC; <br />and <br />WHEREAS, the applicant modified the application pursuant to concerns raised <br />by the Planning Commission, converting 4,500 sq. ft. (of the 5,900 sq. ft.) of ground <br />floor retail into four residential units with entry stoops, lowering the height of the <br />southern building corner by one story, and changing the colors, materials, articulation, <br />and roof form of the southern building element; and <br />WHEREAS, at the January 17, 2017 public hearing, the Planning Commission <br />ultimately supported the Project, as revised, with the added condition that the ground <br />floor unit at the southern corner at EI Camino Real and the alley be converted back to <br />retail, and determined that the proposed Downtown Planned Community Permit <br />including two (2) guideline deviations, Tentative Map, and Affordable Housing Plan <br />would further the purposes of and appropriately implement the City of Redwood City <br />General Plan, applicable provisions of the Redwood City Municipal Code and <br />Downtown Precise Plan, and the 1409 EI Camino Real project, and approved the <br />Project; and <br />WHEREAS, an appeal was filed with the City during the 15 -day appeal period by <br />Kris Johnson on behalf of Redwood City Residents for Responsible Development <br />(Appellant) challenging the Planning Commission's approval of the Project; and <br />ATTY/RESO.0031/ CC RESO ADOPTING DENIAL OF APPEAL BY REDWOOD CITY RESIDENTS FOR RESPONSIBLE DEVELOPMENT <br />REV: 03-30-17 PR RESO.
