04/03/2017 <br />a. The proposed affordable units comply with the standards in Section 18.272, <br />including without limitation compliance with Section 18.272(8) requiring that <br />the affordable units be made available for occupancy concurrently with the <br />market -rate units; and <br />The proposed affordable units would comply with the required standards <br />including providing a comparable quality of construction to onsite market -rate <br />units, making the units available for occupancy at the same time as market - <br />rate units, and ensuring the continued affordability of the units. The affordable <br />units would provide compatible exterior and interior finishes, and amenities as <br />market rate units. This includes the same access to common open space, <br />parking, storage, fitness center, and other onsite facilities. The number of <br />bedrooms and distribution of units within the development would also be <br />comparable to the market -rate units. The affordable units would be available <br />to qualifying very low income households and remain affordable units for a <br />duration of 55 years. <br />b. The affordable units will mitigate the impact of the project on the need for <br />affordable housing. <br />The proposed affordable units mitigate the projects impact on the need for <br />affordable housing by providing a percentage of affordable units at the low <br />income level onsite. This mix of housing affordability will serve a range of <br />users, who will have the same access to goods and services. This partial <br />onsite provision, coupled with the partial in -lieu fee, meets the intent of the <br />Ordinance and mitigates the impact of the project. <br />Section 7. The Downtown Planned Community Permit including two (2) Guideline <br />deviations, Tentative Map, and Affordable Housing Plan are hereby approved based on <br />the City Council's consideration and reliance on the Initial Study (IS) and Downtown <br />Precise Plan EIR and in accordance with the plans, details, descriptions, and conditions <br />of approval contained therein, attached hereto and incorporated herein by reference. <br />Section 8.
