ATTACHMENT 1 implement the City of Redwood City General Plan, applicable provisions of the Redwood City Municipal Code and Downtown Precise Plan, and the 801 Brewster Avenue project; and WHEREAS, an appeal was filed with the City during the 15 -day appeal period by Hunter -Storm, LLC, challenging the Planning Commission's approval of the Project. While the appeal was subsequently withdrawn, it is City policy to hold the required de novo hearing pursuant to City procedures; and WHEREAS, on April 24, 2017 the City Council conducted a duly noticed de novo public hearing in accordance with all applicable requirements of the Subdivision Map Act and the Redwood City Municipal Code, all applicable requirements of the State Planning and Zoning Law, the City Zoning Ordinance and the Downtown Precise Plan, to consider the Project, and received and considered oral and documentary evidence on the application. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: Section 1. Evidentiary Basis: The City Council independently heard, considered, and weighed all the evidence in the record, including without limitation the staff report and the application materials, the letters from the appellant appealing the Project and withdrawing the appeal, the EIR, development plan, tentative map, and all other documents, reports, studies, memoranda, maps, oral and written testimony, and materials in the City's file for the applications and the Project, and all adopted City planning documents relating to the Project and the property including the City's General Plan, Municipal Code, Zoning Ordinance, the Downtown Precise Plan, and other applicable City laws and regulations, and all associated approved and certified environmental documents, have together served as an adequate and appropriate evidentiary basis for the findings and actions set forth in this Resolution. Section 2. Finding: The City Council, upon consideration of the evidence, finds that the above recitals are accurate, that the Planning Commission's decision was not made in error, that there was no abuse of discretion, that the decision was otherwise proper and hereby upholds the decision of Planning Commission to approve the Project. In upholding the Planning Commission's decision, the City Council affirms the findings adopted by the Planning Commission and the Conditions of Approval set forth in Planning Commission Resolution No. 17-02. Section 3. Initial Study Checklist (IS): In upholding the Planning Commission approval, the City Council finds that: a. The IS was prepared in accordance with all legal requirements. b. The City Council has reviewed and analyzed the IS and other information in the entire record and has considered the information contained therein, including the written and oral comments received at the public hearing on the Project, prior to acting upon or approving the Project.
