ATTACHMENT 1 <br />implement the City of Redwood City General Plan, applicable provisions of the <br />Redwood City Municipal Code and Downtown Precise Plan, and the 801 Brewster <br />Avenue project; and <br />WHEREAS, an appeal was filed with the City during the 15 -day appeal period by <br />Hunter -Storm, LLC, challenging the Planning Commission's approval of the Project. <br />While the appeal was subsequently withdrawn, it is City policy to hold the required de <br />novo hearing pursuant to City procedures; and <br />WHEREAS, on April 24, 2017 the City Council conducted a duly noticed de novo <br />public hearing in accordance with all applicable requirements of the Subdivision Map <br />Act and the Redwood City Municipal Code, all applicable requirements of the State <br />Planning and Zoning Law, the City Zoning Ordinance and the Downtown Precise Plan, <br />to consider the Project, and received and considered oral and documentary evidence on <br />the application. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY, AS FOLLOWS: <br />Section 1. Evidentiary Basis: The City Council independently heard, <br />considered, and weighed all the evidence in the record, including without limitation the <br />staff report and the application materials, the letters from the appellant appealing the <br />Project and withdrawing the appeal, the EIR, development plan, tentative map, and <br />all other documents, reports, studies, memoranda, maps, oral and written testimony, <br />and materials in the City's file for the applications and the Project, and all adopted City <br />planning documents relating to the Project and the property including the City's General <br />Plan, Municipal Code, Zoning Ordinance, the Downtown Precise Plan, and other <br />applicable City laws and regulations, and all associated approved and certified <br />environmental documents, have together served as an adequate and appropriate <br />evidentiary basis for the findings and actions set forth in this Resolution. <br />Section 2. Finding: The City Council, upon consideration of the evidence, finds <br />that the above recitals are accurate, that the Planning Commission's decision was not <br />made in error, that there was no abuse of discretion, that the decision was otherwise <br />proper and hereby upholds the decision of Planning Commission to approve the Project. <br />In upholding the Planning Commission's decision, the City Council affirms the findings <br />adopted by the Planning Commission and the Conditions of Approval set forth in <br />Planning Commission Resolution No. 17-02. <br />Section 3. Initial Study Checklist (IS): In upholding the Planning Commission <br />approval, the City Council finds that: <br />a. The IS was prepared in accordance with all legal requirements. <br />b. The City Council has reviewed and analyzed the IS and other information in the <br />entire record and has considered the information contained therein, including the <br />written and oral comments received at the public hearing on the Project, prior to <br />acting upon or approving the Project. <br />ATTY/RESO.0036/CC RESO UPHOLDING PC APPROVAL -801 BREWSTER RESO.
