09/11/2017 <br />RESOLUTION NO. 15619 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY UPHOLDING AN APPEAL AND DENYING <br />THE REQUEST FOR A CONDITIONAL USE PERMIT AND <br />ARCHITECTURAL PERMIT FOR A NEW CHARTER ELEMENTARY <br />SCHOOL AT 860 CHARTER STREET <br />WHEREAS, Applicant, Launchpad Development Company, applied for a <br />Conditional Use Permit for non -conforming parking stall size and driveway width <br />and a n Architectural Permit to renovate the existing building at 860 Charter Street <br />for a new Rocketship Charter Elementary School with 480 students in Transitional <br />Kindergarten through fifth grade with landscape, parking and on-site circulation <br />improvements (the "Project"); and <br />WHEREAS, on November 1, 2016, the Planning Commission ("Commission") <br />conducted a public hearing to consider the Project and associated Initial <br />Study/Mitigated Negative Declaration (IS/MND) and continued the hearing to provide <br />staff and consultants time to respond to comments; and <br />WHEREAS, on March 14, 2017, the City released for public review, the <br />Responseto Comments memo and on June 8, 2017, the City released for public review a <br />revised Response to Comments memo including updated traffic counts and responding <br />to all comments received on the IS/MND; and <br />WHEREAS, on April 4, 2017, the Commission conducted a public hearing to <br />considerthe Project and IS/MND and received public comment on the application. The <br />Commission then continued the hearing in order to provide an opportunity to evaluate <br />and respond to additional comments including a traffic analysis submitted by a member <br />of the public; and <br />WHEREAS, on June 20, 2017, the Commission considered and adopted the <br />IS/MND prepared in accordance with the requirements of the California <br />Environmental Quality Act (CEQA) and, based on the adopted IS/MND, adopted a <br />Mitigation Monitoring and Reporting Program in compliance with CEQA <br />requirements, as part of the City's consideration of the Project; and <br />WHEREAS, on June 20, 2017, the Commission conducted a duly noticed public <br />hearing, in accordance with all applicable requirements of the Redwood City Municipal <br />Code and State Planning and Zoning Law, to consider Conditional Use Permit No. <br />UP2014-20 and Architectural Permit No. AP2014-66, and received and considered <br />oral and documentary evidence in favor of and opposed to the application; and the <br />Commission, by a vote of 4 in favor and 3 opposed adopted Resolution No. 17-08 <br />determining that the proposed Conditional Use Permit and Architectural Permit, for <br />the Project would not be in conflict with the purpose and intent of the City of Redwood <br />ATTY/RESO.0086/CC RESO DENYING ROCKETSHIP CUP & AP RESO.
