"City Council' means the City Council of the City of Redwood City, <br /> California. <br /> "City Documents" means collectively, this Agreement, the Regulatory <br /> Agreement, the Memorandum and the Grant Deed. <br /> "City Planning Commission" means the City Planning Commission of the <br /> City of Redwood City. <br /> "Certificate of Completion" is defined in Section 5. 12. <br /> '`Claims" is defined in Section 5. 14. <br /> "Closing Date" or "Close of Escrow" shall be the date that escrow closes <br /> for the conveyance of the Property to Developer. <br /> "Conditions of Approval" is defined in Section 5 .4. <br /> "Creekside Trail Improvement Agreement" is defined in Section 5.22. <br /> "Creekside Trail Parcel" is defined in Recital B. <br /> "Construction Plans" is defined in Section 5.6. <br /> "Developer" means MP Bradford Associates, a California limited <br /> partnership. <br /> "Developer's Permitted Exceptions" is defined in Section 3 . 1 . <br /> "Effective Date" is stated in the preamble to this Agreement, and means the <br /> date that this Agreement is fully-executed following approval by the City Council. <br /> "Environmental Laws" is defined in Section 6.8.2. <br /> "Environmental Reports" means collectively, that certain Phase I report <br /> dated October 28, 2004 prepared by Green Environment, Inc., that certain Phase II <br /> report dated November 26, 2004 prepared by Green Environment, Inc., that certain <br /> Report on Additional Evaluation of Soil and Groundwater dated April 17, 2006 <br /> prepared by Green Environment, Inc., and that certain Site Investigation Report <br /> dated March 3, 2011 prepared by Green Environment, Inc.. <br /> "Escrow Agent" is defined in Section 3 .3 . <br /> "Fee Parcel AI" and "Fee Parcel A2" are defined in Recital B. <br /> "Financing Plan" is defined in Section 2.5. 1 . <br /> "Grant Deed" is defined in Section 3. 1 . <br /> ATY/AGR/2017.218/RWC — BRADFORD — DDA <br /> REV: 09-18-17 VR <br /> Page 4 of 94 <br />
