<br />ATTY/CHARTER AMENDMENTS/2018/2018 FINAL CHARTER AMENDMENTS <br />REV: 07-18-18 VR <br />Page 39 of 45 <br />labor, or material or supplies at a higher price or rate than that proposed by any other bidder, or <br />shall favor one bidder over another, giving or withholding information, or shall willfully mislead <br />any bidder in regard to the character of the material or supplies called for, or shall knowingly <br />accept materials or supplies of a quality inferior to that called for by the contract, or shall <br />knowingly certify to a greater amount of labor performed than has actually been performed, or <br />to the receipt of a greater amount of material or supplies than has actually been received. <br /> <br />Section 81. FORFEITURE OF OFFICE FOR FRAUD: <br /> <br />Every officer who shall willfully approve, allow, or pay any demand on the treasury not authorized <br />by law, shall be liable to the cCity individually and on his their official bond, for the amount of <br />the demand so approved, allowed, or paid, and shall forfeit such office and be forever disbarred <br />and disqualified from holding any position in the service of the cCity. <br /> <br />Section 82. DISPOSITION OF PUBLIC MONEYS: <br /> <br />All cCity officials, and employees empowered to collect money for fees, permits, licenses, <br />inspections, services, taxes or other municipal charges, shall collect the same promptly at the <br />time they become due, turn them in to the cCity treasury daily, obtain a receipt therefor, and <br />report the same to the cCity aAuditor daily. The cCouncil may by ordinance provide for the <br />depositing and reporting of moneys at such other time periods as found appropriate, but not less <br />often than weekly. All such moneys and all fines or pecuniary penalties or forfeitures which may <br />accrue to the cCity, and all funds which may remain in the possession of the cCity unclaimed after <br />a period of one year from the date when due and payable shall be credited to the gGeneral fFund <br />of the cCity, and shall be applicable to any purpose to which the cCouncil may appropriate them, <br />and the cCouncil shall appropriate from this fund whatever sum may be necessary to pay valid <br />claims of more than one year's standing. (As amended April 9, 1968, approved by Legislature <br />April 29, 1968, Stats. 1968, Chapter 76.) <br /> <br />Section 83. PUBLIC RECORDS: <br /> <br />All books and records of every office and department shall be open to the inspection of any citizen <br />during business hours, subject to the proper rules and regulations for the efficient conduct of the <br />business of such department or office; but the records of the police department shall not be <br />subject to such inspection except by permission of the proper police authorities. <br /> <br />Section 84. COPIES OF RECORDS: <br /> <br />Copies or extracts, duly certified, from said books and records open for inspection, shall be given <br />by the officer having the same in custody to any person demanding the same and tendering the <br />fee therefor as provided by ordinance. (As amended April 13, 1954, ratified by Legislature <br />January 13, 1955, Stats. 1955, Chapter 27.) <br /> <br />
