10/22/2018 WHEREAS, the public service easements to be vacated by the City are not useful as a non -motorized transportation facility as they are partially located beneath existing buildings. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY AS FOLLOWS: 1. The recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. 2. Pursuant to Section 8333 of the California Streets and Highways Code, the four public service easements described in Exhibit A, Exhibit B, Exhibit C, and Exhibit D have been superseded by relocation, or determined to be excess, or both, and there are no other public facilities located within the easements. 3. The four public service easements described in Exhibit A, Exhibit B, Exhibit C and Exhibit D, are hereby ordered vacated. From and after the date this resolution is recorded, the public service easements vacated shall no longer constitute public service easements. 4. The City Manager is hereby authorized and directed, upon receipt of a signed Storm Drain and Water Line Easement deed from the County of San Mateo, to accept on behalf of the City and execute the Certificate of Acceptance for the Storm Drain and Water Line Easement deed substantially in the form shown in Exhibit E. 5. The City Manager is hereby authorized to accept and execute on behalf of the City all additional documents necessary to effectuate said vacation, execution of deed, and acceptance of deed. 6. The City Clerk is hereby authorized and directed to record, or cause to be recorded, a certified copy of this resolution, the aforesaid Storm Drain and Water Line Easement deed, and associated documents pertaining thereto, in the office of the County Recorder of the County of San Mateo.
