A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD SUMMARILY VACATING FOUR PUBLIC SERVICE EASEMENTS ON COUNTY -OWNED PROPERTY DESIGNATED AS ASSESSOR'S PARCEL NUMBERS 052-337-020 AND 052-341-240 IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE; AUTHORIZING THE CITY MANAGER TO ACCEPT A STORM DRAIN AND WATER LINE EASEMENT DEED IN EXCHANGE THEREFOR; AND DIRECTING THE CITY CLERK TO FILE THE RESOLUTION AND DEED FOR RECORDATION (COUNTY CENTER EASEMENT EXCHANGE)

10/22/2018 <br />WHEREAS, the public service easements to be vacated by the City are not useful <br />as a non -motorized transportation facility as they are partially located beneath existing <br />buildings. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2. Pursuant to Section 8333 of the California Streets and Highways Code, the <br />four public service easements described in Exhibit A, Exhibit B, Exhibit C, and Exhibit D <br />have been superseded by relocation, or determined to be excess, or both, and there are <br />no other public facilities located within the easements. <br />3. The four public service easements described in Exhibit A, Exhibit B, Exhibit <br />C and Exhibit D, are hereby ordered vacated. From and after the date this resolution is <br />recorded, the public service easements vacated shall no longer constitute public service <br />easements. <br />4. The City Manager is hereby authorized and directed, upon receipt of a <br />signed Storm Drain and Water Line Easement deed from the County of San Mateo, to <br />accept on behalf of the City and execute the Certificate of Acceptance for the Storm Drain <br />and Water Line Easement deed substantially in the form shown in Exhibit E. <br />5. The City Manager is hereby authorized to accept and execute on behalf of <br />the City all additional documents necessary to effectuate said vacation, execution of <br />deed, and acceptance of deed. <br />6. The City Clerk is hereby authorized and directed to record, or cause to be <br />recorded, a certified copy of this resolution, the aforesaid Storm Drain and Water Line <br />Easement deed, and associated documents pertaining thereto, in the office of the County <br />Recorder of the County of San Mateo. <br />ATTY/RESO.0095/CC RE50 VACATING FOUR PUBLIC SERVICE EASEMENTS—COUNTY CENTER EASEMENT <br />EXCHANGE RESO.
