RECORDING REQUESTED BY <br />AND WHEN RECORDED RETURN TO: <br />City of Redwood City <br />1017 Middlefield Road <br />Redwood City, California 94063 <br />Attn: City Clerk <br />(Space above this Line for Recorder's Use Only) <br />Storm Drain and Water Line Easement Deed <br />THE UNDERSIGNED GRANTOR DECLARES AS FOLLOWS: <br />The undersigned declares that this Grant Deed is exempt from Recording Fees <br />pursuant to California Government Code section 27383 and exempt from Documentary <br />Transfer Tax pursuant to California Revenue and Taxation Code section 11922. <br />FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, the <br />County of San Mateo (Grantor) hereby GRANT(s) to the City of Redwood City, a charter <br />city and municipal corporation (Grantee), a non-exclusive easement for one permanent <br />water and one storm drain line and their associated facilities and appurtenances <br />("Easement") in and to that certain real property in Redwood City, County of San Mateo, <br />State of California as more particularly described in and shown on Exhibit A, <br />("Easement Area') attached hereto and incorporated herein by this reference. The <br />provisions of this Deed are intended to and will run with the land, and, until their <br />expiration or termination in accordance with the terms of this Deed, will bind, be a <br />charge upon and inure to the benefit of Grantor and Grantee, their respective <br />successors and assigns. <br />THE PURPOSE(S) AND LIMITATIONS ON USE OF THE EASEMENT. The purpose <br />of the Easement shall be to erect, install, construct, remove, repair, replace, reconstruct, <br />maintain and use for storm drain and water line purposes any and all materials, fixtures, <br />appliances, equipment, pipes, pipelines, necessary for the transmission, collection, <br />distribution and delivery of water and storm water utilities over, along, upon, under and <br />across the parcel of real property described in and shown on Exhibit A. <br />Grantor may grant other easements over, along and across the Easement Area so long <br />as such other easements do not interfere with Grantee's purposes and uses of the <br />Easement Area, after obtaining the prior, written consent of Grantee, which consent <br />shall not be unreasonably withheld, and which shall be provided within thirty (30) <br />calendar days after receipt of request therefor.
