WHEREAS, there has been presented to, and reviewed by, this Council a <br />Third Supplemental Agreement to the Basic Agreement consenting to <br />annexation of the above mentioned lands, subject to the condition therein stated <br />that said annexation shall not increase or decrease the allocation of Capacity <br />Rights reserved and conveyed to District under the Basic Agreement; <br />NOW, THEREFORE; <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br />CITY, AS FOLLOWS: <br />That certain agreement entitled, "Third Supplemental Agreement - <br />Sanitary Sewerage Treatment Capacity Rights and Services" (form dated <br />01/10/01), by and between the City of Redwood City, a municipal corporation of <br />the State of California and the Fair Oaks Sewer Maintenance District, <br />supplementing the Basic Agreement and conditionally consenting to the <br />annexation to the District of certain therein described territory, a copy of which <br />agreement is on file in the office of the City Clerk, to which copy reference is <br />hereby made for the full particulars thereof, is hereby approved and the City <br />Manager and City Clerk are hereby authorized and directed to execute and to <br />attest thereto, respectively, said agreement for and on behalf of the City of <br />Redwood City. <br />Reso -1068 2 <br />F Ashared \redwood \cou n ci I <br />DES:djk <br />01/10/01 <br />14124 <br />
