05/06/2019 <br />emissions. <br />7. Insurance. This Section 7 (Insurance) shall survive expiration or other <br />termination of the PDD Permit or PDD Agreement. The insurance carrier is required to <br />maintain an A.M. Best rating of not less than "AMI". Permittee shall, at its own expense, <br />procure and maintain in full force at all times during the term hereof the following <br />insurance: <br />A. Commercial General Liability Coverage. Permittee shall maintain <br />commercial general liability insurance written on an occurrence basis, on a form that <br />provides coverage at least as broad as form ISO CG 00 01, covering the insured with a <br />duty to defend against claims of bodily injury, personal injury and property damage arising <br />out of Permittee's activities, assumed liabilities, or use of any City property (including, <br />without limitation, sidewalks, crosswalks, public thoroughfares, and rights-of-way) (the <br />"City Property"), including contractual liability coverage for the performance by Permittee <br />of the indemnity agreements set forth in this PDD Agreement, and coverage for damage <br />to the City Property (including all improvements in Permittee's care, custody, or control), <br />for limits of no less than two million dollars ($2,000,000) for each occurrence and four <br />million dollars ($4,000,000) annual aggregate limit for bodily injury, personal injury, and <br />one million ($1,000,000) annual aggregate for property damage liability. <br />B. Automobile Liability Insurance. Permittee shall maintain automobile liability <br />insurance covering all vehicles used in the performance hereof providing a one million <br />dollar ($1,000,000) combined single limit per occurrence for bodily injury, personal injury, <br />and property damage. Coverage shall be applicable to all owned, hired, or non -owned <br />vehicles on the City Property. <br />C. Compliance with State Workers' Compensation Requirements. Permittee <br />covenants that it will insure itself against liability for Workers' Compensation pursuant to <br />the provisions of California Labor Code §3700, et seq. Permittee shall, at all times, upon <br />demand of City, furnish proof that Workers' Compensation Insurance is being maintained <br />by it in force and effect in accordance with the California Labor Code. This policy shall <br />include employer's liability coverage with limits not less than $1,000,000 per occurrence. <br />The insurer shall also agree to waive all rights of subrogation against City, its officers, <br />officials, employees, agents, and volunteers for losses arising from work performed by <br />Page 14 of 20 <br />ATTY/DOCS-RESOLUTIONS/2019/RESO.0042 CC RESO PDD PILOT PROGRAM RESO.
