05/06/2019 <br />ii. Permittee shall also provide timely and prompt notice to City if <br />Permittee receives any notice of cancellation or nonrenewal from its <br />insurer. <br />iii. Primary Coverage. Permittee's insurance coverage shall be primary <br />insurance with respect to City, its officers, officials, employees, <br />agents, and volunteers. Any insurance, risk pooling arrangement, or <br />self-insurance maintained by City, its officers, officials, employees, <br />agents, or volunteers shall be in excess of Permittee's insurance and <br />shall not contribute with it. <br />iv. Reporting Provisions. Any failure to comply with the reporting <br />provisions of the policy shall not affect the coverage provided to City, <br />its officers, officials, employees, agents, or volunteers. <br />v. Verification of Coverage. Prior to the commencement date of this <br />PDD Permit, Permittee shall deliver to City certificates of insurance <br />and additional insured policy endorsements from insurers in a form <br />satisfactory to City, evidencing the coverages required hereunder, <br />together with complete copies of the policies at City's request. <br />8. Failure to Comply. If Permittee fails to comply with the requirements of this <br />PDD Agreement or the PDD Permit, City may terminate this PDD Agreement and/or <br />invoke City's rights under Section 9 (Relocation and Removal), below. City shall notify <br />Permittee in writing of the date of termination ("Noticed Termination Date") and identify <br />the deficiencies forming the basis for such termination, at least five (5) business days in <br />advance. If Permittee corrects the deficiencies identified by City prior to the Noticed <br />Termination Date, or commences such correction prior to the Noticed Termination Date <br />and diligently prosecutes same to completion, then this PDD Agreement shall remain in <br />effect. If Permittee does not timely correct the deficiencies, then this PDD Agreement <br />shall automatically terminate and the PDD Permit shall automatically be revoked on the <br />Noticed Termination Date. In the event of any conflict between this provision and <br />Condition of Approval No. 4 (Permit Revocation), Condition of Approval No. 4 (Permit <br />Revocation) shall control.
