05/06/2019 <br />Deputy City Manager (via Alex Khojikian) ten (10) working days prior to initial start of <br />operating PDDs in the City under the 2019 Pilot Program. <br />6. Limitations. The PDD Permit does not constitute a lease, deed, or grant of <br />an easement, or grant of a fee interest by City. The activities authorized by the PDD <br />Permit are limited solely to the purposes expressly set forth in the PDD Agreement and <br />these Conditions of Approval. Construction, excavation, or installation of structures <br />without specific written City approvals is not authorized. City reserves the right to alter, <br />add, and delete from the work authorized required under the PDD Permit. The PDD <br />Permit does not entitle Permittee to install any improvements on all or any portion of the <br />Right of Way, other public space or property, or private property. The Right of Way <br />includes, but is not limited to, thoroughfares, streets, roads, alleys, lanes, walkways, <br />public spaces, sidewalks, crosswalks, driveways, and other rights of way, except streets <br />and highways forming part of the state highway in the City of Redwood City whether or <br />not improved or accepted for maintenance by City. <br />7. Responsible Party. No party other than the named Permittee is authorized to <br />operate PDDs pursuant to a PDD Permit. <br />8. Acceptance. It is understood and agreed by Permittee that the doing of any <br />work under the PDD Permit shall constitute an acceptance of the provisions of the PDD <br />Agreement, the PDD Permit, all attachments, and applicable provisions of the Redwood <br />City Municipal Code and other laws. <br />9. Fees and Deposits: Other Required Permits. Permittee shall pay the fees, <br />deposits, and other securities to City as set forth in the PDD Agreement before the PDD <br />Permit is issued. Permittee and its contractors shall also apply for and obtain a City <br />Business License for its operations within the City of Redwood City. Permittee shall, <br />whenever by law, secure the written authorization for any work that must be approved by <br />the Public Utilities Commission (PUC) of the State of California, Department of Motor <br />Vehicles, CAL -OSHA, San Mateo County, or any other agency having jurisdiction. Failure <br />to comply with the law, as noted above, will invalidate the PDD Permit. <br />10. PDD Operation. Subject to compliance with the PDD Agreement and the <br />PDD Permit (including these Conditions of Approval), Permittee may operate up to <br />Page 4 of 20 <br />ATTY/DOCS-RESOLUTIONS/2019/RESO.0042 CC RESO PDD PILOT PROGRAM RESO.
