Subdivision Map Act and the Redwood City Code to consider Tentative Map
<br /> Applications; and
<br /> WHEREAS, on October 4, 2016 , the Commission considered the staff reports,
<br /> oral and written , and testimony and materials presented by all those wishing to be heard
<br /> on this Project at the noticed public hearing on this matter; and
<br /> WHEREAS, the Commission considered a CEQA Consistency Checklist and its
<br /> findings prepared by the City's Planning Division , the previously certified Stanford in
<br /> Redwood City Environmental Impact Report (the "EIR") (State Clearinghouse
<br /> #2008102023) , including the Statement of Overriding Considerations in City Council
<br /> Resolution No . 15294 , as part of the City's consideration of the Project; and
<br /> WHEREAS , on October 4 , 2016 , the Commission conducted a duly noticed
<br /> public hearing , in accordance with all applicable requirements of the State Planning and
<br /> Zoning Law, the Redwood City Code, and the Redwood City Zoning Ordinance, to
<br /> consider approval of the Project, and received and considered oral and written reports
<br /> and application materials; and
<br /> WHEREAS , the Commission determined that the proposed Project is consistent
<br /> with the Precise Plan goals, development standards, and urban design guidelines and
<br /> applicable provisions of the Redwood City Municipal Code and Zoning Ordinance, and
<br /> Subdivision Map Act; and
<br /> WHEREAS, an appeal was filed with the City during the 15-day appeal period by
<br /> Kris Johnson , challenging the Planning Commission's approval of the Project; and
<br /> WHEREAS , on December 12 , 2016 the City Council conducted a duly noticed de
<br /> novo public hearing in accordance with all applicable requirements of the Subdivision
<br /> Map Act and the Redwood City Municipal Code, all applicable requirements of the State
<br /> Planning and Zoning Law, the City Zoning Ordinance and the Stanford Precise Plan , to
<br /> consider the appeal of the Project, and received and considered oral and documentary
<br /> evidence on the appeal and application ; and
<br /> NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
<br /> THE CITY OF REDWOOD CITY, AS FOLLOWS :
<br /> Section 1 . Evidentiary Basis : The City Council independently heard ,
<br /> considered , and weighed all the evidence in the record , including without limitation the
<br /> staff report and the application materials, the letter from the Appellant, the EIR,
<br /> development plan , tentative map, and all other documents, reports, studies,
<br /> memoranda, maps, oral and written testimony, and materials in the City's file for the
<br /> applications and the Project, and all adopted City planning documents relating to the
<br /> Project and the property including the City's General Plan , Municipal Code, Zoning
<br /> Ordinance, the Precise Plan , and other applicable City laws and regulations, and all
<br /> associated approved and certified environmental documents, have together served as
<br /> ATTY/RESO.0123/CC RESO DENYING APPEAL & APPROVING THE STANFORD PROJECT RESO. NO. 15551
