03/21/2011 <br /> ORIGINAL <br /> RESOLUTION NO 15104 <br /> RESOLUTION DECLARING THE RESULTS OF A SPECIAL ELECTION AND <br /> ORDERING CHANGES TO THE PROCEEDINGS REGARDING CITY OF <br /> REDWOOD CITY COMMUNITY FACILITIES DISTRICT NO. 2010 -1 (ONE <br /> MARINA) AND APPROVING CERTAIN MATTERS WITH RESPECT THERETO <br /> WHEREAS, under the provisions of the Mello -Roos Community Facilities Act of 1982, <br /> constituting Section 53311 et seq. of the California Government Code (the "Law "), this City <br /> Council has previously formed a community facilities district under the Law known as the City of <br /> Redwood City Community Facilities District No. 2010 -1 (One Marina) (the "District "); and <br /> WHEREAS, on this date, at the request of R.C. Peninsula Park, LLC, a Delaware limited <br /> liability company (the "Petitioner"), the sole landowner within the District, this City Council <br /> adopted a resolution entitled "Resolution of the City Council of the City of Redwood City <br /> Declaring its Consideration of Amending Certain Provisions Relating to City of Redwood City <br /> Community Facilities District No. 2010 -1 (One Marina)" (the "Resolution of Consideration "), to <br /> (a) amend the Rate and Method of Apportionment of Special Tax (the "RMA ") as approved by <br /> the City Council by Resolution No. 15048 adopted on August 9, 2010 (the "Resolution of <br /> Intention "), (b) to amend the description of the facilities eligible for funding by the District (the <br /> "Facilities ") as set forth in Exhibit B of the Resolution of Intention, so as to remove the payment <br /> of certain impact and school fees previously authorized, as set forth in Exhibit B hereto; (c) to <br /> reduce the authorized special tax bonds and appropriations limit for the District to an amount <br /> not to exceed $7,500,000; and (d) to authorize the removal of certain property exempt from <br /> taxation under the RMA from the District upon the filing of a final map; and <br /> WHEREAS, on this date, this City Council held the public hearing as required by the <br /> Law and the Resolution of Consideration relative to the proposed changes to the District; and <br /> WHEREAS, at the hearing all interested persons desiring to be heard on all matters <br /> pertaining to the proposed changes relating to the District were heard and a full and fair hearing <br /> was held; and <br /> WHEREAS, written protests with respect to the changes to the proceedings relating to <br /> the District have not been filed with the City Clerk by property owners of one -half (1/2) or more <br /> of the area of land within the District and not exempt from the special tax; and <br /> WHEREAS, on March 21, 2011 this City Council adopted a resolution entitled <br /> "Resolution Calling Special Election Within Community Facilities District No. 2010 -1 (One <br /> Marina) Regarding Certain proposed Amendments," calling for a special election of the qualified <br /> electors within the District; and <br /> WHEREAS, pursuant to the terms of said resolution, which are by this reference <br /> incorporated herein, the special election was held on March 21, 2011, and the City Clerk has on <br /> file a Canvass and Statement of Results of Election, a copy of which is attached hereto as <br /> Exhibit A; and <br /> WHEREAS, this City Council has reviewed the canvass and hereby approves it; and <br /> ATTY /RESO.2112 /OF CHANGE ATTACH 3 ONE MARINA Reso # 15104 <br /> 030411 MUFF # 506 <br /> -1- <br />
