03/21/2011 ORIGINAL RESOLUTION NO 15104 RESOLUTION DECLARING THE RESULTS OF A SPECIAL ELECTION AND ORDERING CHANGES TO THE PROCEEDINGS REGARDING CITY OF REDWOOD CITY COMMUNITY FACILITIES DISTRICT NO. 2010 -1 (ONE MARINA) AND APPROVING CERTAIN MATTERS WITH RESPECT THERETO WHEREAS, under the provisions of the Mello -Roos Community Facilities Act of 1982, constituting Section 53311 et seq. of the California Government Code (the "Law "), this City Council has previously formed a community facilities district under the Law known as the City of Redwood City Community Facilities District No. 2010 -1 (One Marina) (the "District "); and WHEREAS, on this date, at the request of R.C. Peninsula Park, LLC, a Delaware limited liability company (the "Petitioner"), the sole landowner within the District, this City Council adopted a resolution entitled "Resolution of the City Council of the City of Redwood City Declaring its Consideration of Amending Certain Provisions Relating to City of Redwood City Community Facilities District No. 2010 -1 (One Marina)" (the "Resolution of Consideration "), to (a) amend the Rate and Method of Apportionment of Special Tax (the "RMA ") as approved by the City Council by Resolution No. 15048 adopted on August 9, 2010 (the "Resolution of Intention "), (b) to amend the description of the facilities eligible for funding by the District (the "Facilities ") as set forth in Exhibit B of the Resolution of Intention, so as to remove the payment of certain impact and school fees previously authorized, as set forth in Exhibit B hereto; (c) to reduce the authorized special tax bonds and appropriations limit for the District to an amount not to exceed $7,500,000; and (d) to authorize the removal of certain property exempt from taxation under the RMA from the District upon the filing of a final map; and WHEREAS, on this date, this City Council held the public hearing as required by the Law and the Resolution of Consideration relative to the proposed changes to the District; and WHEREAS, at the hearing all interested persons desiring to be heard on all matters pertaining to the proposed changes relating to the District were heard and a full and fair hearing was held; and WHEREAS, written protests with respect to the changes to the proceedings relating to the District have not been filed with the City Clerk by property owners of one -half (1/2) or more of the area of land within the District and not exempt from the special tax; and WHEREAS, on March 21, 2011 this City Council adopted a resolution entitled "Resolution Calling Special Election Within Community Facilities District No. 2010 -1 (One Marina) Regarding Certain proposed Amendments," calling for a special election of the qualified electors within the District; and WHEREAS, pursuant to the terms of said resolution, which are by this reference incorporated herein, the special election was held on March 21, 2011, and the City Clerk has on file a Canvass and Statement of Results of Election, a copy of which is attached hereto as Exhibit A; and WHEREAS, this City Council has reviewed the canvass and hereby approves it; and ATTY /RESO.2112 /OF CHANGE ATTACH 3 ONE MARINA Reso # 15104 030411 MUFF # 506 -1-
