<br />6.1C <br />Page 2 <br /> <br />Installations, which will be located within 2 to 4 feet of the storefront windows, will rotate <br />every 3 months. In some cases, where window exhibits are not practical, murals may <br />be created on plywood panels or construction fencing. Meetings and discussions have <br />been held with 2 Fish and various property owners, artists and galleries. <br /> <br />A key component of the program is the ability to access the buildings of the vacant <br />storefronts to install the exhibits and or provide murals. 2 Fish will coordinate the <br />installation of the exhibits with the property owners and be on site during all <br />installations. The professional services contract with 2 Fish has the appropriate <br />indemnification and liability insurance clauses for this function. However, a Right of <br />Entry and License Agreement (Agreement) between the Redevelopment Agency and <br />the property owner is required to access and utilize the privately owned spaces for the <br />Phantom Galleries Program. See Attachment 2 for sample Agreement. Staff is <br />requesting that the Agency Board grant the Executive Director the authority to enter into <br />such agreements with property owners in order to expeditiously implement the Phantom <br />Gallery Program. It is also possible that the Agreement may be used for special <br />promotions connected to holiday displays or other promotions. It should also be noted <br />that the exhibits will be removed within ~ days of notification by the property owner <br />that the space has been leased. <br /> <br />One of the central goals articulated in the Downtown Precise Plan is to restore <br />Downtown as the indispensable hub of the City with a mix of diverse services, <br />conveniences, and experiences that includes a range of cultural offerings. There are a <br />several galleries and artist studios in the Downtown, with more planned and/or under <br />construction. The Phantom Gallery Program will provide a new venue for showcasing <br />the work of local artists and help enliven the pedestrian experience. It is recommended <br />that the Agency Board approve the recommendation so that the Program can be <br />implemented. <br /> <br />AL TERNA TIVES <br />Do not grant the authority to enter into the agreements and do not proceed with the <br />implementation of the Phantom Gallery Program, <br /> <br />FISCAL IMPACT <br /> <br />There is no direct fiscal impact to the Right of Entry Agreements, other than the liability <br />risks assumed by the Agency pursuant to the Right of Entry Agreements. The. Agency <br />has transferred a substantial portion of this risk to 2 Fish in the Professional Services <br />Agreement executed with them to implement and install the Phantom Galleries <br />Program.
