restriping of East Bayshore Road south of Whipple Avenue and the extension of <br />East Bayshore Road to Maple Street'; and <br />WHEREAS, as of the date of City's approval of this Agreement, City has <br />not adopted a Citywide or Areawide traffic impact fee program applicable to the <br />Project pursuant to Government Code Section 66000, et seq. (the "Mitigation <br />Fee Act "), nor has City established an assessment district or other financing <br />mechanism to fund the Emergency Access or other roadway improvements to <br />mitigate traffic impacts from existing, approved, and /or pending developments <br />along Bayshore Road and the Bair Island Area and vicinity thereof (collectively <br />referred to as the "Funding Programs "); and <br />WHEREAS, notwithstanding that City has not adopted such Funding <br />Programs and regardless of whether City has adopted such Funding Programs <br />or any one of them prior to issuance of the building permits required for the <br />construction of the Project, pursuant to the conditions of approval of the Planned <br />Development and Final Map, City and Owner desire to provide for the funding of <br />off -site roadway improvements for the Project in accordance with this <br />Agreement. <br />NOW, THEREFORE, <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br />CITY, AS FOLLOWS: <br />13836 <br />F: \shared \Redwood \Council\ 4 <br />Reso -802 <br />FXS:fs <br />01/05/00 <br />
