3/13/00 <br />0 R I G I y A L <br />RESOLUTION NO. 13349 <br />A RESOLUTION OF INTENTION <br />OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />TO FORM A COMMUNITY FACILITIES DISTRICT AND <br />LEVY A SPECIAL TAX IN, AND APPROVING BOUNDARY MAP FOR, <br />CITY OF REDWOOD CITY COMMUNITY FACILITIES DISTRICT NO. 2000-1 <br />(PACIFIC SHORES PROJECT) <br />WHEREAS, it is proposed to establish a community facilities district within the City of <br />Redwood City under the terms of the Community Facilities Act of 1982, Chapter 2.5 of Part 1 of <br />Division 2 of Title 5 of the California Government Code, commencing with Section 53311. The <br />proposed boundaries of the district are shown on the Map of Proposed Boundary on file with the <br />City Clerk. The Map of Proposed Boundary shall be filed for record in the Book of Maps of <br />Assessment and Community Facilities Districts in the office of the County Recorder of the <br />County of San Mateo no later than fifteen (15) days after adoption of this Resolution of <br />Intention; and <br />WHEREAS, the name of the proposed community facilities district shall be "City of <br />Redwood City Community Facilities District No. 2000 -1 (Pacific Shores Project)" (the "CFD "); <br />and <br />WHEREAS, the types of public facilities and services proposed to be provided within the <br />CFD are set forth on Exhibit A attached to this Resolution. The Council hereby finds that these <br />facilities and services are necessitated by new development occurring and anticipated within the <br />CFD; and <br />WHEREAS, the types of incidental expenses proposed to be incurred are set forth on <br />Exhibit B attached to this Resolution; and <br />WHEREAS, except where funds are otherwise available, a special tax sufficient to pay <br />for all such facilities and services will be annually levied within the CFD. Upon recordation of a <br />notice of special tax lien pursuant to Section 3114.5 of the California Streets and Highways <br />Code, a continuing lien to secure each levy of the special tax shall attach to all nonexempt real <br />property within the CFD, and this lien shall continue in force and effect until the special tax <br />obligation is paid or prepaid and permanently satisfied and the special tax lien is canceled in <br />accordance with law or until collection of the tax by the City ceases. The rate and method of <br />apportionment of the special tax is set forth in Exhibit C to this Resolution; and <br />WHEREAS, advances of funds or contributions of work in kind from any lawful source, <br />specifically including owners of property within the CFD, may be reimbursed from bond <br />proceeds or from special tax revenue or both to the extent of the lesser of the value or cost of the <br />contribution, but any agreement to do so shall not constitute a debt or liability of the City; and <br />WHEREAS, the Council hereby sets Monday, April 17, 2000, at 7:30 p.m., at the City of <br />Redwood City City Hall Council Chambers located at 1017 Middlefield Road, Redwood City, <br />Redwood Reso of Intention.DOC 1 <br />
