3/13/00 0 R I G I y A L RESOLUTION NO. 13349 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY TO FORM A COMMUNITY FACILITIES DISTRICT AND LEVY A SPECIAL TAX IN, AND APPROVING BOUNDARY MAP FOR, CITY OF REDWOOD CITY COMMUNITY FACILITIES DISTRICT NO. 2000-1 (PACIFIC SHORES PROJECT) WHEREAS, it is proposed to establish a community facilities district within the City of Redwood City under the terms of the Community Facilities Act of 1982, Chapter 2.5 of Part 1 of Division 2 of Title 5 of the California Government Code, commencing with Section 53311. The proposed boundaries of the district are shown on the Map of Proposed Boundary on file with the City Clerk. The Map of Proposed Boundary shall be filed for record in the Book of Maps of Assessment and Community Facilities Districts in the office of the County Recorder of the County of San Mateo no later than fifteen (15) days after adoption of this Resolution of Intention; and WHEREAS, the name of the proposed community facilities district shall be "City of Redwood City Community Facilities District No. 2000 -1 (Pacific Shores Project)" (the "CFD "); and WHEREAS, the types of public facilities and services proposed to be provided within the CFD are set forth on Exhibit A attached to this Resolution. The Council hereby finds that these facilities and services are necessitated by new development occurring and anticipated within the CFD; and WHEREAS, the types of incidental expenses proposed to be incurred are set forth on Exhibit B attached to this Resolution; and WHEREAS, except where funds are otherwise available, a special tax sufficient to pay for all such facilities and services will be annually levied within the CFD. Upon recordation of a notice of special tax lien pursuant to Section 3114.5 of the California Streets and Highways Code, a continuing lien to secure each levy of the special tax shall attach to all nonexempt real property within the CFD, and this lien shall continue in force and effect until the special tax obligation is paid or prepaid and permanently satisfied and the special tax lien is canceled in accordance with law or until collection of the tax by the City ceases. The rate and method of apportionment of the special tax is set forth in Exhibit C to this Resolution; and WHEREAS, advances of funds or contributions of work in kind from any lawful source, specifically including owners of property within the CFD, may be reimbursed from bond proceeds or from special tax revenue or both to the extent of the lesser of the value or cost of the contribution, but any agreement to do so shall not constitute a debt or liability of the City; and WHEREAS, the Council hereby sets Monday, April 17, 2000, at 7:30 p.m., at the City of Redwood City City Hall Council Chambers located at 1017 Middlefield Road, Redwood City, Redwood Reso of Intention.DOC 1
