4/24/00 <br />0RIGINAL <br />CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />RESOLUTIONNO. 13891 <br />RESOLUTION CALLING SPECIAL ELECTION IN <br />CITY OF REDWOOD CITY COMMUNITY FACILITIES DISTRICT NO. <br />2000 -1 (PACIFIC SHORES PROJECT) <br />WHEREAS, the Council is conducting proceedings under and pursuant to the Mello - <br />Roos Community Facilities Act of 1982, as amended (the "Act"), to form the City of Redwood <br />City Community Facilities District No. 2000 -1 (Pacific Shores Project), City of Redwood City, <br />County of San Mateo, California (the "District "), to authorize the levy of special taxes upon the <br />land within the District, and to issue bonds in one or more series secured by said special taxes for <br />the purposes of providing moneys for the construction and acquisition of improvements within <br />the District; and <br />WHEREAS, the Council has adopted Resolution No. 13889 (Resolution of <br />Formation of the District and to Levy a Special Tax) and Resolution No. 13890 <br />(Resolution Deeming It Necessary to Incur Bonded Indebtedness). <br />NOW, THEREFORE, BE IT RESOLVED, as follows: <br />1. The levy of special tax proposed in the Resolution of Formation shall be <br />submitted to the voters pursuant to Government Code Section 53326. <br />2. The authorization to issue bonded indebtedness proposed in the Resolution <br />Deeming It Necessary to Incur Bonded Indebtedness shall be submitted to the voters pursuant to <br />Government Code Section 53355. <br />3. The setting of the appropriations limit shall be submitted to the voters pursuant to <br />Government Code Section 53325.7. <br />4. The three ballot questions just described shall be combined into a single ballot <br />measure pursuant to Government Code Section 53353.5. The ballot language shall be as shown <br />on the form of ballot attached hereto as Exhibit A, which form of ballot is hereby approved. <br />5. The Council hereby finds that the special tax will not be apportioned in any tax <br />year on any portion of property in the District in residential use in that tax year. Based upon <br />such finding and additionally based on the Certificate of Developer heretofore filed with this <br />City Council, the qualified electors for the election to be held in these proceedings shall be the <br />landowners owning land within the District. This City Council hereby accepts the Certificate of <br />Developer heretofore filed in these proceedings and finds, in accordance therewith, that there <br />presently are, or at some point in the 90 days just past there have been, fewer than 12 registered <br />voters residing within the boundaries of the District.
