8/14/00 <br />O R I G I N A L <br />RESOLUTION NO. 13g7 <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br />OF AGREEMENT GRANTING ENCROACHMENT FOR THE <br />CONSTRUCTION, INSTALLATION AND MAINTENANCE OF <br />FIBER OPTIC CABLES AND RELATED FACILITIES WITHIN THE <br />PUBLIC RIGHT -OF -WAY WITHIN THE REDWOOD SHORES <br />RESIDENTIAL AREA <br />(RCN TELECOM SERVICES OF CALIFORNIA, INC.) <br />WHEREAS, RCN Telecom Services of California, Inc., a California <br />Corporation, wishes to install and maintain fiber optic network facilities within the <br />public right of way within the Redwood Shores Residential area, in the City of <br />Redwood City; and <br />WHEREAS, under California law, the City of Redwood City may regulate <br />the location and the manner of construction, installation, and maintenance of <br />network facilities in the public right -of -way within the limits of the City of Redwood <br />City; and <br />NOW, THEREFORE; <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br />CITY, as follows: <br />That certain permit agreement entitled "Encroachment Agreement <br />between the City of Redwood City and RCN Telecom Services of California, Inc. <br />For the Installation of Fiber Optic Network Facilities Within the Public Right of <br />Way (Redwood Shores Residential Area)," (form dated 08/02/OOR) by and <br />between the City of Redwood City, a municipal corporation of the State of <br />Reso -952R <br />sh /mdcouncil/reso <br />FXS:fs <br />08/02/00 <br />
