Description
RESOLUTION DECLARING THAT THE PUBLIC INTEREST OR NECESSITY DEMANDS THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY PURSUANT TO THE PROVISIONS OF SECTION 68 OF THE CHARTER OF THE CITY OF REDWOOD CITY AND SECTION 20168 OF THE PUBLIC CONTRACT CODE OF THE STATE OF CALIFORNIA WITHOUT ADVERTISING FOR BIDS FOR THE CONSTRUCTION OF CERTAIN REPLACEMENT PUBLIC ACCESS FACILITIES HEREIN DESCRIBED, APPROVING CONTRACT DOCUMENTS, AND RATIFYING AND AUTHORIZING EXECUTION OF AN AGREEMENT FOR SUCH WORK

1. Findinas. This Council hereby finds and determines that the aforesaid <br />recitals are true statements of fact and are incorporated herein by reference. <br />2. Declaration. This Council hereby declares that, based upon the <br />aforesaid findings, an emergency condition exists and that the public interest or <br />necessity demands the immediate expenditure of public money pursuant to the <br />provisions of Section 68 of the Charter of the City of Redwood City and Section <br />20168 of the Public Contract Code of the State of California for the construction <br />of the Replacement Improvements without advertising for bids therefor. <br />3. ADDroval. Those certain contract documents and plans entitled, <br />"Redwood Shores Levee Improvement Project Mitigation —BCDC Observation <br />Decks With Access Walk," prepared by the Community Development Services <br />Department are hereby approved. <br />4. Acceotance/Authorization. That certain bid, solicited without <br />advertising, submitted by Waring Construction, Inc., dated April 27, 2001, in the <br />total amount of Two Hundred Thirty-two Thousand Two Hundred Forty -eight <br />Dollars ($232,248) for the construction of the Replacement Improvements is <br />hereby accepted, and the City Manager is hereby authorized and directed to <br />execute an agreement (in form approved by the City Attorney) for the <br />construction of the Replacement Improvements, and any all purchase orders or <br />other documents implementive of said contract heretofore issued or entered into <br />by or on behalf of the City are hereby ratified. <br />5.
