RESOLUTION DECLARING THAT THE PUBLIC INTEREST OR NECESSITY DEMANDS THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY PURSUANT TO THE PROVISIONS OF SECTION 68 OF THE CHARTER OF THE CITY OF REDWOOD CITY AND SECTION 20168 OF THE PUBLIC CONTRACT CODE OF THE STATE OF CALIFORNIA WITHOUT ADVERTISING FOR BIDS FOR THE CONSTRUCTION OF CERTAIN REPLACEMENT PUBLIC ACCESS FACILITIES HEREIN DESCRIBED, APPROVING CHANGE ORDER TO CONTRACT DOCUMENTS, AND AUTHORIZING EXECUTION OF THE CHANGE ORDER FOR SUCH WORK (Waring Construction, Inc.)

WHEREAS, the Department of Community Development Services has <br />solicited not less than three (3) bids without formal advertisement for the <br />construction of the Pathway Improvements; and <br />WHEREAS, this Council desires to approve and ratify the execution of an <br />agreement with the lowest responsible bidder for the construction of the Pathway <br />Improvements as hereinafter described; <br />NOW, THEREFORE; <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS <br />FOLLOWS: <br />1. Findings. This Council hereby finds and determines that the aforesaid <br />recitals are true statements of fact and are incorporated herein by reference. <br />2. Declaration. This Council hereby declares that, based upon the <br />aforesaid findings, an emergency condition exists and that the public interest or <br />necessity demands the immediate expenditure of public money pursuant to the <br />provisions of Section 68 of the Charter of the City of Redwood City and Section <br />20168 of the Public Contract Code of the State of California for the construction <br />of the Pathway Improvements without advertising for bids therefor. <br />3. Approval. Those certain contract documents and plans entitled, <br />"Change Order #1 to Redwood Shores Levee Improvement Project Mitigation— <br />BCDC Observation Decks With Access Walk," prepared by the Community <br />Development Services Department are hereby approved. <br />4. Acceptance /Authorization. That certain bid, solicited without <br />advertising, submitted by Waring Construction, Inc., dated July 18, 2001, in the <br />-3- <br />R W C /Comdev <br />RES00829 <br />08/29/01 <br />14377 <br />
