O R I G I N A L 4/14/03 <br />RESOLUTION NO. 14523 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AUTHORIZING ACQUISITION OF PROPERTY AND <br />THE EXPENDING OF FUNDS THEREFOR, AND THE INSTITUTION <br />OF EMINENT DOMAIN PROCEEDINGS <br />ASSESSOR'S PARCEL NOS. 095 -040 -350; 095 - 151 -160 <br />OWNERS: Oracle Corporation, A California Corporation; Oracle <br />Real Estate Corporation, A California Corporation; Daniel <br />Properties VIII, A Virginia Limited Partnership <br />WHEREAS, the Government Code of the State of California Sections 37350.5, <br />37353, and 40404, and Code of Civil Procedure Sections 1230.020, 1240.010, <br />1240.020, 1240.110, and 1240.120, et seq., provide for the acquisition of private <br />property necessary to carry out any of the City's powers or functions and for the public <br />use described herein; and <br />WHEREAS, the public interest and necessity require the acquisition of fee and <br />easement interests in and to portions of real property hereinafter described above, for a <br />public use, namely, for the Ralston /Marine Parkway Interchange Improvement Project in <br />the City of Redwood City and the City of Belmont ( "the Project "); and <br />WHEREAS, pursuant to the Code of Civil Procedure Section 1245.235, notice <br />and an opportunity to be heard was given to the owner(s) of the property which is the <br />subject of this Resolution as the person(s) shown on the last equalized county <br />assessment role; and <br />WHEREAS, pursuant to Government Code Section 7267.2 the owner(s) of <br />record was offered just compensation for the real property hereinafter described; and <br />WHEREAS, the public interest and necessity require the acquisition of the <br />property hereinafter described on Exhibit "A ", for a public use, namely, the <br />Ralston /Marine Parkway Interchange Improvement Project to modify the existing full- <br />cloverleaf interchange to a partial- cloverleaf interchange, widen local city streets, and <br />F:Atty /Reso /Resol.1387 <br />Fitzgerald /040703 1 <br />
