O R I G I N A L 4/14/03 RESOLUTION NO. 14523 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AUTHORIZING ACQUISITION OF PROPERTY AND THE EXPENDING OF FUNDS THEREFOR, AND THE INSTITUTION OF EMINENT DOMAIN PROCEEDINGS ASSESSOR'S PARCEL NOS. 095 -040 -350; 095 - 151 -160 OWNERS: Oracle Corporation, A California Corporation; Oracle Real Estate Corporation, A California Corporation; Daniel Properties VIII, A Virginia Limited Partnership WHEREAS, the Government Code of the State of California Sections 37350.5, 37353, and 40404, and Code of Civil Procedure Sections 1230.020, 1240.010, 1240.020, 1240.110, and 1240.120, et seq., provide for the acquisition of private property necessary to carry out any of the City's powers or functions and for the public use described herein; and WHEREAS, the public interest and necessity require the acquisition of fee and easement interests in and to portions of real property hereinafter described above, for a public use, namely, for the Ralston /Marine Parkway Interchange Improvement Project in the City of Redwood City and the City of Belmont ( "the Project "); and WHEREAS, pursuant to the Code of Civil Procedure Section 1245.235, notice and an opportunity to be heard was given to the owner(s) of the property which is the subject of this Resolution as the person(s) shown on the last equalized county assessment role; and WHEREAS, pursuant to Government Code Section 7267.2 the owner(s) of record was offered just compensation for the real property hereinafter described; and WHEREAS, the public interest and necessity require the acquisition of the property hereinafter described on Exhibit "A ", for a public use, namely, the Ralston /Marine Parkway Interchange Improvement Project to modify the existing full- cloverleaf interchange to a partial- cloverleaf interchange, widen local city streets, and F:Atty /Reso /Resol.1387 Fitzgerald /040703 1
