REVOCABLE PERMIT <br />FOR <br />REDWOOD CREEK PROPERTY <br />Pursuant to the provisions of Resolution No. of the Council of the City <br />of Redwood City, adopted December 5, 2005, permission is hereby granted to Frederick <br />W. Earnhardt, Jr. dba Docktown Marina (hereinafter called "Permittee "), to use real <br />property of the City of Redwood City (hereinafter called "City ") described in that <br />document labeled "Exhibit 1," and depicted, for the convenience of the parties, on <br />Exhibit "2" (hereinafter called "the Subject Premises "), attached hereto and incorporated <br />herein by this reference, for the purpose of conducting a commercial small boat marina <br />business, which may include no more than 47 residential berths (subject to the City (1) <br />receiving acquiescence or approval by the State Lands Commission that the Subject <br />Property may be used as such, (2) Docktown Marina, Inc. applying for a Use Permit <br />from the City within 30 days from the date of approval of this Revocable Permit by City, <br />and (3) approval of a Use Permit by the Zoning Administrator) and the right to maintain <br />piers, docks, wharves, floats and other facilities necessary or convenient for the <br />berthing and servicing of boats, including the operation of a sailing school, a yacht sales <br />and brokerage business, and for no other purpose. <br />1. This permit is temporary in nature, does not constitute a deed or grant of <br />easement, and may be revoked without cause at any time at the will of the Council of <br />the City of Redwood City, effective immediately upon giving notice of such revocation to <br />Frederick W.
