<br />1/9/2006 <br /> <br />ORIGINAL <br /> <br />RESOLUTION NO. 14687 <br /> <br />A RESOLUTION Of THE CITY Of REDWOOD CITY APPROVING THE <br />RIGHT-Of-WAY USE AGREEMENT WITH NEXTG NETWORKS TO <br />INSTALL AND MAINTAIN MICRO-CELLULAR OPTICAL REPEATER <br />EQUIPMENT <br /> <br />WHEREAS, NextG Networks, a Delaware corporation based in San Jose, wishes <br />to install and maintain micro-cellular optical repeater equipment on certain City-owned <br />facilities; and <br /> <br />WHEREAS, under California law, the City of Redwood City may regulate the <br />location and manner of construction, installation and maintenance of micro-cellular <br />optical repeater equipment in the public right-of-way within the limits of the City of <br />Redwood City. <br /> <br />NOW, THEREfORE, BE IT RESOLVED BY THE COUNCIL Of THE CITY Of <br />REDWOOD CITY AS fOLLOWS: <br /> <br />1. <br /> <br />That certain agreement entitled "Right-of-Way Use Agreement" dated <br />, 2005, by and between the City of Redwood City and NextG <br />Networks of California, Inc., granting authorization to NextG for the <br />installation, maintenance and repair of micro-cellular optical repeater <br />equipment on certain City-owned facilities, a copy of which agreement is on <br />file in the office of the City Clerk, to which copy reference is hereby made for <br />the full particulars thereof, is hereby approved. <br /> <br />2. <br /> <br />The City Manager and City Clerk are hereby authorized and directed to <br />execute and to attest thereto, respectively, said agreement for and on behalf <br />of the City of Redwood City. <br /> <br />* * * <br /> <br />Atty/Ord.1588 <br />121305 <br /> <br />14687 <br />Muff # 304 <br />
