<br />02/13/2006 <br /> <br />the City to pay 100% of the actual cost of the installation of a 24-inch recycled water <br /> <br />transmission line in the Highway 101 right-a-way; and <br />WHEREAS, in order to get funding approval from the California Transportation <br /> <br />Commission, CalTrans requires an approved contribution agreement with the City of <br /> <br />Redwood City; and <br /> <br />WHEREAS, CalTrans informed city staff that two provisions related to state <br /> <br />statutes had been inadvertently omitted from the CalTrans agreement as set forth <br /> <br />below and has requested that these two provisions be incorporated into the agreement; <br /> <br />and <br /> <br />WHEREAS, the two provisions to be added to the CalTrans agreement shall <br /> <br />read as follows: <br /> <br />11. <br /> <br />In the event future construction or improvement of Route 101 necessitates <br /> <br />the relocation or removal of IMPROVEMENT, the CITY will relocate or <br /> <br />remove the same at CITY's sole expense. <br /> <br />12. <br /> <br />CITY agrees that Water costs charged to STATE will never exceed 80% of <br /> <br />the cost of potable water delivered to any other CITY customer and that <br /> <br />the allocation to STATE is su perior to other su bsequent users and Water <br /> <br />supply will not be diverted or reduced so as to render STATE's converted <br /> <br />water delivery system unusable. <br /> <br />WHEREAS, the one additional amendment to Article 10 of Section III to the <br /> <br />CalTrans agreement shall read as follows: <br /> <br />10. <br /> <br />This Agreement shall terminate upon completion and acceptance of the <br /> <br />construction contract for PROJECT by STATE and final disposition of <br /> <br />F:Atty/Reso/Reso.1592 <br />013106 <br /> <br />2 <br /> <br />14692 <br />Muff #304 <br />
