<br />11/10/2008 <br /> <br />times for inspection and audit by any authorized representative of <br /> <br />the DEPARTMENT. <br /> <br />ARTICLE V - TERMINATION OF CONTRACT <br /> <br />A. Either DEPARTMENT or GRANTEE may unilaterally terminate this <br /> <br />CONTRACT if a material breach of the CONTRACT is made by the <br /> <br />other; such termination shall become effective NINETY [90] DAYS <br /> <br />following the date of receipt by either the DEPARTMENT or the <br /> <br />GRANTEE of a written notice of termination from the party <br /> <br />initiating the termination. <br /> <br />B. The GRANTEE may terminate this CONTRACT if the GRANTEE becomes <br /> <br />financially or legally unable to comply with the terms and <br /> <br />conditions of this CONTRACT; such termination shall become <br /> <br />effective NINETY [90] DAYS following receipt by the DEPARTMENT of <br /> <br />a written notice of termination from the GRANTEE and the patrol <br /> <br />boat will be returned to the DEPARTMENT. <br /> <br />C. The DEPARTMENT may terminate this CONTRACT immediately and be <br /> <br />relieved of any payments should the legislative body of the <br /> <br />GRANTEE fail to appropriate GRANTEE FUNDS or if the GRANTEE fails <br /> <br />to perform the requirements of this Agreement at the time and in <br /> <br />the manner herein provided; such termination to become effective <br /> <br />upon receipt by the GRANTEE of a written termination notice from <br /> <br />the DEPARTMENT. <br /> <br />3 <br /> <br />14906 <br />MUFF 706 <br />
