Personal injury means injury, other than bodily injury, arising out of one or more of the <br />following offenses: <br />(a) False arrest, detention or imprisonment, abuse of process, or malicious <br />prosecution; <br />(b) Wrongful entry into, or eviction of a person from, a room, dwelling, or premises <br />that the person occupies; <br />(c) Publication or utterance of material that slanders or libels a person or organization <br />or disparages a person's or organization's goods, products, or services, or oral or <br />written publication of material that violates a person's right of privacy; <br />(d) Discrimination or violation of civil rights; and <br />(e) Injury resulting from the use of reasonable force for the purpose of protecting <br />persons or property. <br />16. Pollutants means any solid, liquid, gaseous, or thermal irritant or contaminant, including <br />smoke, vapor, soot, fumes, acids, alkalis, chemicals, airborne particles or fibers, molds <br />and /or fungus, and waste. Waste includes materials to be discarded or to be recycled, <br />reconditioned, or reclaimed. The term pollutants, as used herein, does not mean potable <br />water, agricultural water, water furnished to commercial users, or water used for fire <br />suppression.. <br />17. Property damage means: <br />(a) Physical injury to tangible property, including all resulting loss of use of that <br />property; or <br />(b) Loss of use of tangible property that is not physically injured or destroyed. <br />18. Public officials errors and omissions means any, actual or alleged misstatement or <br />misleading statement or act or omission by any covered Party, individually or <br />collectively, arising in the course and scope of their duties with the covered party or <br />claimed against them solely by reason of their being or having been public officials or <br />employees, and which results in damage neither expected nor intended from the <br />standpoint of the covered party. All claims involving the same misstatement or <br />misleading statement or act or omission or a series of continuous or repeated <br />misstatements or misleading statements or acts or omissions will be considered as arising <br />out of one occurrence. <br />19. Retained Iimit means the amount stated on the applicable Declarations or certificate of <br />coverage, which will be paid by the covered party before the Authority is obligated to <br />make any payment from the pooled funds.
