RESOLUTION APPROVING THE SOLE SOURCE PURCHASE OF FIVE MAIN PUMPS AND MOTORS FROM FLOWSERVE, IN AN AMOUNT NOT TO EXCEED $400, 000, AND SUSPENDING THE REQUIREMENTS OF ARTICLE VII, PURCHASING, OF CHAPTER 2 OF THE MUNICIPAL CODE RELATING TO COMPETITIVE BIDDING FOR THIS PURCHASE, AUTHORIZING THE ASSIGNMENT OF THIS SOLE SOURCE PURCHASE AGREEMENT TO THE SUCCESSFUL BIDDER, AND APPROVING $10, 000 FOR FLOWSERVE TO START THE SUBMITTAL PROCESS

11/09/2009 <br />shop drawings of other supplier's pumps would delay receipt of the units; and <br />WHEREAS, if the pumps are provided by Flowserve, they will be available for <br />installation to meet the demands of the 2010 irrigation season. <br />NOW, THEREFORE; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct and are hereby <br />incorporated by this reference as if fully set forth in their entirety. <br />2. Pursuant to Redwood City Code Section 2.76, the requirements of Article VII, <br />PURCHASING, of Chapter 2 of the Redwood City Code relating to competitive bidding are <br />suspended for this purchase. <br />3. Strict compliance with Article II, Chapter 2 of the Redwood City code would not <br />serve the public interest because for the reasons set forth in the recitals above, it is more <br />efficient and economical to acquire compatible pump equipment that are available from a single <br />source only, Flowserve. <br />4. The sole source purchase of five main pumps and motors from Flowserve for an <br />amount not to exceed $400,000 is approved. <br />5. The sole source purchase agreement for the purchase of five main pumps and <br />motors from Flowserve, to be negotiated and completed prior to the advertisement of the public <br />works project to install the five pumps, shall be assigned to the successful bidder on said public <br />works project. <br />6. Approve $10,000 of the $400,000 sole source purchase amount for Flowserve to <br />prepare submittals for the five main pumps and motors. <br />ATTY /RESO /RESO.1960 14982 <br />111009 MUFF # 802 <br />
