_ 0 R I G I N A L -- 5/22/96 <br /> <br /> RESOLUTION NO. 12760 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br /> OF SEI'rLEMENT AGREEMENT AND RELINQUISHMENT OF <br /> ACCESS RIGHTS FOR CONSTRUCTION OF STREET <br /> WIDENING ON JEFFERSON AVENUE; ACCEPTING <br /> RELINQUISHMENT OF ACCESS RIGHTS AND GRANT OF NON- <br /> ACCESS LINE; AND ACCEPTING TEMPORARY <br /> CONSTRUCTION EASEMENT <br /> <br /> WHEREAS, the City of Redwood City has undertaken the construction of <br />a railroad crossing underpass on Jefferson Avenue, between Middlefield Road <br />and El Camino Real, Redwood City, California, (the "Project"); and <br /> <br /> WHEREAS, the Project requires the acquisition of a non-access line on <br />Jefferson Avenue along the property located at 932 Middlefield Road, Redwood <br />City, California; and <br /> <br /> WHEREAS, the Project requires that the City of Redwood City acquire a <br />Temporary Construction Easement for a period of 26 months during the <br />construction of the Project. <br /> <br /> NOW, THEREFORE, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD <br />CITY AS FOLLOWS, that: <br /> <br /> 1. That certain agreement entitled, "Settlement Agreement and <br />Relinquishment of Access Rights," (form dated 04/08/96) by and between the <br />City of Redwood City, a municipal corporation of the State of California and JAN <br />K. NOVAK and ANTOINE'i-rE M.
