<br />DES:mf 10/20/81 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />8984 <br /> <br />OCT 2 6 1981 <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br />OF AGREEMENT PROVIDING FOR WASTEWATER TREATMENT <br />CAPACITY RIGHTS (PARKWOOD 101 ASSOCIATES) <br /> <br />ORIGIN.AL <br /> <br />WHEREAS, parkwood 101 Associates, a Texas general partnership <br /> <br />("Parkwood") is the owner of certain undeveloped lands ("parkwood's <br /> <br />Lands") located on Redwood peninsula in the City of Redwood City; <br /> <br />and <br /> <br />WHEREAS, this City is a party to that certain Joint Exercise <br /> <br />of Powers Agreement establishing the South Bayside System Authority, <br /> <br />a public entity, which currently provides sanitary sewerage transmission <br /> <br />and disposal services to the sanitary sewerage service area of this <br /> <br />City and to other constituent agencies of said Authority; and <br /> <br />WHEREAS, said Authority is presently constructing, and proposes <br /> <br />to operate and maintain new sanitary sewerage treatment facilities <br /> <br />in conjunction with its present transmission and disposal facilities <br /> <br />to serve its service area which includes Parkwood's Lands; and <br /> <br />WHEREAS, construction of said new sanitary sewerage treatment <br /> <br />facilities 1S funded in part by federal and state grants, together <br /> <br />with local public funds, but the capacity of said facilities so <br /> <br />grant-funded to treat sewage is restricted by federal and state <br /> <br />regulations implementive of the Federal Water Pollution Control <br /> <br />Act, as amended; and <br /> <br />WHEREAS, in view of said restrictions, no treatment capacity <br /> <br />will be available to treat sewage which might emanate from <br /> <br />Parkwood's Lands unless funding for the construction of such <br /> <br />non-grant funded capacity is furnished from sources other than <br /> <br />federal, state, or local public funds; and <br /> <br />WHEREAS, Parkwood desires to acquire from this City, and <br /> <br />this City is willing to sell to Parkwood, the right to use sanitary <br /> <br />, i' . <br />>J r-\ /~ <br />........
