<br />DCB:rks 3/08/84 <br /> <br />ORIGINAL.~ <br /> <br />MAR 1 2 1984 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9537 <br /> <br />RESOLUTION ADDING RULE XX TO THE PERSONNEL RULES AND <br />REGULATIONS OF THE CITY OF REDWOOD CITY MAKING THE <br />PROVISIONS OF CODE OF CIVIL PROCEDURE SECTION 1094.6 <br />APPLICABLE TO CERTAIN ADMINISTRATIVE DECISIONS, AND <br />ESTABLISHING TIME LIMITS FOR JUDICIAL REVIEW THEREOF <br /> <br />WHEREAS, Section 1094.6 of the Code of Civil Procedure <br /> <br />establishes certain time limits within which a petition for writ <br /> <br />of mandate pursuant to Section 1094.5 of said code may be filed <br /> <br />for review of a final decision of a local agency suspending, <br /> <br />demoting, or dismissing an officer or employee or pertaining to <br /> <br />certain other specified entitlements; and <br /> <br />WHEREAS, subdivision (g) of said Section 1094.6 provides <br /> <br />that said section shall be applicable to a local agency only if <br /> <br />the governing body thereof adopts an ordinance or resolution <br /> <br />making said section applicable; and <br /> <br />WHEREAS, this council desires to make Section 1094.6 <br /> <br />applicable with respect to decisions suspending, demoting, or <br /> <br />dismissing officers or employees of the City; <br /> <br />NOW THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1. By adoption hereof and the amendment specified in <br /> <br />Paragraph 2 hereof, this Council hereby makes applicable the <br /> <br />provisions of <br /> <br />Section 1094.6 of the Code of Civil Procedure <br /> <br />to petitions for writs of mandate filed pursuant to Section <br /> <br />1094.5 of said code for review of final decisions suspending, <br /> <br />demoting, or dismissing officers or employees of the City of <br /> <br />Redwood City. <br /> <br />9537 <br />
