<br />DES:rks 3/29/84 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9545 <br /> <br />ORIGINAL <br />APR 2 1984 <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />SUPPLEMENTAL AGREEMENT III TO JOINT EXERCISE OF POWERS <br />AGREEMENT FOR THE SOUTH BAYS IDE SYSTEM AUTHORITY <br /> <br />WHEREAS, the Cities of Belmont, Redwood City, and San <br /> <br />Carlos, California and the Menlo Park Sanitary District (now <br /> <br />named the West Bay Sanitary District) entered into that certain <br /> <br />Agreement dated November 13, 1975, entitled "Joint Exercise of <br /> <br />Powers Agreement <br /> <br />South Bayside <br /> <br />System Authority" <br /> <br />(the <br /> <br />"Agreement"), and two Supplemental Agreements thereto dated for <br /> <br />convenience as of June 8, 1977 and June 1, 1983, respectively; <br /> <br />and <br /> <br />WHEREAS, the Agreement establishes the South Bayside System <br /> <br />Authority to finance, acquire and construct, and to manage, <br /> <br />operate and maintain the Joint Facilities to include, among other <br /> <br />facili ties, Stage 1 and Stage 2 of the proj ect, as said Joint <br /> <br />Facilities, Stages and Project are defined in the Agreement; and <br /> <br />WHEREAS, Stage 1 of the Project is now operative, and the <br /> <br />Commission of the South Bayside System Authority has proposed to <br /> <br />finance, acquire and construct Stage 2 of the Project; and <br /> <br />WHEREAS, various provisions of the Agreement and the first <br /> <br />Supplemental Agreement thereto do not reflect current operational <br /> <br />characteristics of Stage 1 of the Project, appropriate allocation <br /> <br />of capacity rights, certain administrative requirements and <br /> <br />official title or name changes, nor do they specifically provide <br /> <br />for the financing, acquisition and construction of Stage 2 of the <br /> <br />Project; and <br /> <br />9545 <br />
