<br />DES:rks 5/10/84 <br /> <br />OmGiNP,L <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9578 <br /> <br />MAY 14 1984 <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />SETTLEMENT AGREEMENT AND MASTER WATER SALES CONTRACT <br />WITH THE CITY AND COUNTY OF SAN FRANCISCO <br /> <br />WHEREAS, the City of Redwood City is a party plaintiff in <br /> <br />that certain action entitled City of Palo Alto, et ale v. City <br /> <br />and County of San Francisco, etc. (United States District Court, <br /> <br />Northern District of California, No. C 74 1997 RHS) , and is also <br /> <br />a member of the Bay Area Water Users Association, comprised of a <br /> <br />substantial number of the party plaintiffs in said action; and <br /> <br />WHEREAS, said action was filed for the purpose of obtaining <br /> <br />judicial relief with respect to certain alleged rate-making <br /> <br />practices of the City and County of San Francisco, which agency <br /> <br />supplies water to this City and the other party plaintiffs <br /> <br />pursuant to that certain federal legislation known as the IIRaker <br /> <br />Actll, 38 Stat. 242 (1913); and <br /> <br />WHEREAS, that certain agreement commencing as of June 6, <br /> <br />1961 by and between the City of Redwood City and the City and <br /> <br />County of San Francisco providing for the sale of a domestic <br /> <br />water supply to this City for resale throughout its service area <br /> <br />expired June 5, 1981, but said agreement has been continued on an <br /> <br />annual basis since said expiration date; and <br /> <br />WHEREAS, upon the recommendation of the Bay Area Water Users <br /> <br />Association, the plaintiffs in the aforesaid litigation desire to <br /> <br />settle said law suit in accordance with an agreement hereinafter <br /> <br />described and, in connection therewith, also to provide for the <br /> <br />9578 <br />
