<br />DRS:djg-c 7/10/84 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9633 <br /> <br />ORIGINPIL <br />JUL 2 3 1984 <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF SUPPLEMENT <br />TO SETTLEMENT AGREEMENT AND MASTER WATER SALES CONTRACT <br />WITH THE CITY AND COUNTY OF SAN FRANCISCO <br /> <br />WHEREAS, pursuant to Resolution No. 9578 adopted May 14, <br /> <br />1984 this Council approved and authorized execution of that <br /> <br />certain Settlement Agreement and Master Water Sales Contract (the <br /> <br />"Agreement") with the City and County of San Francisco providing <br /> <br />for settlement of litigation therein described and providing for <br /> <br />the future sale and purchase of a domestic water supply to the <br /> <br />plaintiffs in said action and to other purveyors of such water <br /> <br />within the San Francisco Bay Area served by the City and County <br /> <br />of San Francisco pursuant to that certcdn federal legislation <br /> <br />known as the "Raker Act", 38 Stat. 242 (1913); and <br /> <br />WHEREAS, subsequent to approval of the Agreement a proposed <br /> <br />initiative measure entitled "Taxation: Initiative Constitutional <br /> <br />Amendment" (the "Initiative") qualified for the November 1984 <br /> <br />California General Election; and <br /> <br />WHEREAS, the Initiative would revise Article XIII A of the <br /> <br />California Constitution and impose new procedural and substantive <br /> <br />requirements on taxes and fees levied by local governments in the <br /> <br />State of California; and <br /> <br />WHEREAS, in light of uncertainties ca st by the Initiative <br /> <br />upon the abilities of the parties to the Agreement to carry out <br /> <br />their respective duties and obligations thereunder, the City and <br /> <br />County of San Francisco conditionally approved the Agreement; and <br /> <br />9 6 3 ~3 <br />
