<br />SWC:sh 1/18/85 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9779 <br /> <br />ORIGINAL' <br />JAN 2 1 1985 <br /> <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />AMENDMENT TO AGREEMENT FOR SLOPE MAINTENANCE AND WATER <br />QUALITY CONTROL <br /> <br />WHEREAS, pursuant to Resolution No. 9512, adopted January <br /> <br />23, 1984, the City of Redwood City entered into an agreement <br /> <br />("Initial Agreement") with the Paragon Group relating to slope <br /> <br />maintenance and water quality control in the area of One and <br /> <br />Three Lagoon Drive in the Redwood Shores area of the City the <br /> <br />("Property"); and <br /> <br />WHEREAS, Paragon Redwood Shores Company, Ltd., successor in <br /> <br />interest to the Paragon Group's interests in the Property has <br /> <br />requested that the Initial Agreement be amended to reflect the <br /> <br />new ownership of the Property, and to more clearly define the <br /> <br />rights and responsibilities of both parties; and <br /> <br />WHEREAS, there has presented to this Council an Amendment <br /> <br />and Restatement of Agreement, and it is the intent of this <br /> <br />Council to approve such Amendment and Restatement and to <br /> <br />authorize its execution; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br /> <br />REDWOOD CITY, AS FOLLOWS: <br /> <br />1. <br /> <br />That <br /> <br />certain <br /> <br />Agreement <br /> <br />entitled <br /> <br />"Amendment <br /> <br />and <br /> <br />Restatement of Agreement" (form dated 1/17/85), which Agreement <br /> <br />fully amends and restates the Initial Agreement adopted pursuant <br /> <br />to Resolution No. 9512, a copy of which Amendment and Restatement <br /> <br />of Agreement is on file in the office of the City Clerk, to which <br /> <br />9779 <br />
