LIABILITY INSURANCE. <br /> <br />A policy or policies of public liability insurance insuring <br />the Lot Owners (including the personal liability exposure of <br />individual Owners) against any liability to the public, the City, <br />the Lot OWners and their invitees or tenants, incident to the <br />ownership and/or use of the Road arising from claims for personal <br />injury, death or property damage occurring upon, in or about the <br />Road, or any other improvements, fixtures or equipment located <br />thereon or therein, or in or about sidewalks. Limits of <br />liability under such insurance shall be not less than One Million <br />Dollars ($1,000,000.00) for bodily injury or death, One Hundred <br />Thousand Dollars ($100,000.00) for property damage for each <br />occurrence, and One Million Dollars ($1,000,000.00) for <br />comprehensive personal liability coverage. Such limits shall be <br />reviewed by Lot Owners representing fifty percent (50%) or more <br />of the assessed cost at least annually and shall be increased as <br />necessary to reflect inflation in property values and awards for <br />personal injury or wrongful death. Any such policy shall be <br />issued on a comprehensive liability basis, shall be <br />cross-liability endorsed so as not to prejudice the rights of the <br />named insured with respect to any action against another named <br />insured, shall provide for a full waiver of all defenses based <br />upon acts of insured, and shall provide that it may not be <br />cancelled without ten (10) days' prior written notice to the Lot <br />OWners. <br /> <br />The cost of said insurance shall be assessed to each Lot <br />equally, and within fifteen (15) days after notification the <br />assessment shall be paid into the Maintenance Fund established in <br />Section 5.1. <br /> <br />Notwithstanding the foregoing, in the event Lot Owners are <br />unable to obtain insurance coverage in the amounts, or for the <br />risks, specified hereinabove at reasonable cost after extending <br />diligent efforts to obtain such insurance. Lot OWners may apply <br />to the Council of Redwood City for an exception to the said <br />requirements, which the Council may grant as to amounts of <br />coverage and/or risks covered as the Council, in its discretion, <br />shall determine, subject to approval as to form by the City <br />Attorney of the City of Redwood City. If Owners wish to apply to <br />the Council for an exception to the said requirements, OWners <br />shall do so by filing its application for said exception with the <br />City Clerk of the City of Redwood City. <br /> <br />3 <br />
