<br />DES:sh 2/17/87 <br /> <br />(#30) <br /> <br />day) sanitary sewerage treatment capacity rights for the benefit <br />of lands located wi thin the area thereafter established as the <br />Emerald Lake Heights Sewer Maintenance District; and <br />WHEREAS, pursuant to Resolution No. 9690, adopted October 9, <br />1984 by the Council of the City of Redwood City, the lands <br />hereinafter described (the "Excluded Territory") were annexed to <br />the City of Redwood City; and <br />WHEREAS, pursuant to Section 4926 of the Sewer Maintenance <br />District Act (Health and Safety Code ~~4860 et seq.) the Council <br />of the City of Redwood City has adopted a resolution requesting <br />exclusion of the Excluded Territory from the Emerald Lake Heights <br />Sewer Maintenance District; and <br />WHEREAS, the County and the City desire to confirm that <br />treatment capacity rights allocated to the County pursuant to the <br />Capacity Agreement in the amount of one (1) dwelling unit <br />equivalent (250 gallons per day of wastewater volume) shall be <br />reallocated to the City for treatment of sewage emanating from <br />the Excluded Territory and that the allocation of treatment <br />capaci ty rights under the Capacity Agreement shall be reduced <br />correspondingly; and <br />WHEREAS, paragraph XI of the Transmission Agreement provides <br />that said agreement may be revised, altered, amended or <br />supplemented by written agreement; and <br />WHEREAS, the parties hereto desire to supplement the <br />Transmission Agreement by providing for the exclusion of the <br />Excluded Territory in the service area specified in said <br />Agreement; <br /> <br />2 <br />
