'I'L <br />i~ I b j i'Ji1 <br /> <br />APR 1 1 1988 <br />RESOLUTION CONSENTING TO TRANSFER OF WASTEWATER <br />TREATMENT CAPACITY RIGHTS FOR USE OF CERTAIN PROPERTY <br />WITHIN OAK KNOLL SEWER MAINTENANCE DISTRICT <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />1 0767 <br /> <br />WHEREAS, <br /> <br />pursuant to that certain agreement entitled <br /> <br />"Agreement - Wastewater Treatment Capacity (Emerald Lake Hills <br /> <br />Area)" dated August 19, 1980 (the "Capacity Agreement") by and <br /> <br />between the City of Redwood City ("City") and the County of San <br /> <br />Mateo <br /> <br />("County" ) <br /> <br />wastewater treatment capacity rights are <br /> <br />allocated by the City for the benefit of areas within the County <br /> <br />(the "Emerald Lake Hills Service Area"); and <br /> <br />WHEREAS, the Emerald Lake Hills Service Area, as defined and <br /> <br />described in the Capacity Agreement, includes the wastewater <br /> <br />service area of the Oak Knoll Sewer Maintenance District, but <br /> <br />specifically excludes therefrom certain parcels of property <br /> <br />receiving wastewater treatment service from City, one of which <br /> <br />such <br /> <br />parcels <br /> <br />is <br /> <br />hereinafter <br /> <br />described <br /> <br />(the <br /> <br />"Development <br /> <br />Property"); and <br /> <br />WHEREAS, paragraph 3(c) of the Capacity Agreement provides <br /> <br />that County may, upon written consent of City, evidenced by <br /> <br />resolution of City's City Council, dispose of "Non-Grant Eligible <br /> <br />Capacity Rights" <br /> <br />(as said term is defined in the Capacity <br /> <br />Agreement) to any person or other entity for use outside the <br /> <br />Emerald Lake Hills Service Area; and <br /> <br />WHEREAS, County, on behalf of the owners of the Development <br /> <br />Property have applied for consent to the transfer of Non-Grant <br /> <br />Eligible Capacity pursuant to paragraph 3 (c) of the Capacity <br /> <br />Agreement for use with respect to the Development Property; and <br /> <br />10767 <br />
