<br />DRS:djk 04/07/88 <br /> <br />(#21) <br /> <br />the over-all requirements for capacity wi thin the Emerald <br /> <br />Lake Hills Service Area; and <br /> <br /> <br />(d) Although the wastewater volume portion of the capacity <br /> <br /> <br />rights proposed to be transferred is less than 0.1 mgd (as <br /> <br />specified under the Capacity Agreement with respect to <br /> <br /> <br />consenting to transfers of capacity rights) it is necessary <br /> <br /> <br />to account for allocations of capacity rights among and <br /> <br /> <br />between properties within, and outside of, the Emerald Lake <br /> <br />Hills Service Area so as properly to distribute such <br /> <br /> <br />allocations in accordance with County's planning and land <br /> <br /> <br />use regulations and to avoid exceeding limitations upon such <br /> <br /> <br />allocations; therefore this consent is appropriate. <br /> <br />2. The amount of Non-Grant Eligible Capacity to which this <br /> <br /> <br />consent to transfer pertains is that capacity consumed by the <br /> <br /> <br />equivalent of 5 dwelling units (or, 1,350 gallons per day <br /> <br /> <br />wastewater volume [0.00135 mgd]). <br /> <br />3.
