<br />DES:djk l2/08/88 <br /> <br />(003/39) <br /> <br />7. <br /> <br />REMOVAL. <br /> <br />Permittee acknowledges and agrees that upon <br /> <br />revocation of this permit, upon thirty (30) days' prior notice, <br /> <br />at its own cost and expense, Permittee shall remove the <br /> <br />above-described sculpture and shall restore the Subject Premises <br /> <br />to its condition immediately prior to the installation of said <br /> <br />sculpture, reasonable wear and tear excepted. <br /> <br />8. <br /> <br />RELEASE. <br /> <br />Permittee shall be solely responsible and <br /> <br />liable for all damages to persons or property, including the <br /> <br />injury or death of persons, due directly or indirectly to <br /> <br />Permittee's installation and maintenance of the said sculpture, <br /> <br />and shall promptly pay any just claim therefor and shall defend, <br />indemnify and hold the City of Redwood City, its Council, <br /> <br />officers, boards, commissions, agents and employees, harmless <br /> <br />from all suits, actions, damages, or claims to which said City <br /> <br />may be subjected by reason of said installation and maintenance, <br /> <br />or the encroachment upon the Subject Premises or use thereof <br /> <br />permitted hereunder. <br /> <br />Permittee shall further release and hold City harmless from <br /> <br />any destruction to, or alteration of, Permittee's said sculpture <br /> <br />by City, or its employees, agents or contractors, (except for <br /> <br />such destruction or alteration caused by the willful act or gross <br /> <br />negligence of the City, its employees, agents or contractors) in <br /> <br />the exercise of City's ownership rights to the Subject Premises. <br /> <br />9. <br /> <br />INSURANCE. <br /> <br />Permittee shall secure, carry and maintain <br /> <br />at all times during the period covered by this revocable permit, <br /> <br />at Permittee's sole cost and expense, <br /> <br />commercial general <br /> <br />3 <br /> <br />1. fn'!-l.1 '7"'. <br />.
