<br />MJP:mron l2/l5/88 (#23/053) <br /> <br />the pump station at Sandpiper Lagoon Unit #l equals or exceeds <br /> <br />the value of the temporary access easement; <br /> <br />NOW THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br /> <br />AS FOLLOWS: <br /> <br /> <br />1. That the City Council of Redwood City hereby releases <br /> <br /> <br />and quitclaims to Sandpiper Lagoon Homeowners Association and <br /> <br />First Southwest Diversified Partners all of Redwood City's right, <br /> <br /> <br />title, and interest in and to the interim access easement, and <br /> <br /> <br />agrees that the Right of Use and License, recorded in the County <br /> <br /> <br />of San Mateo on July 29, 1987 as Document No. 87117985 is hereby <br /> <br />terminated and is of no further force or effect. <br /> <br /> <br />2. That the City Council of Redwood City hereby accepts <br /> <br />the grant of a permanent easement to the pump station through the <br /> <br /> <br />private streets of Sandpiper Lagoon Unit #l, as described in the <br /> <br /> <br />legal description of Easement Area, attached hereto as Exhibit <br /> <br /> <br />"A" and in that certain proposed agreement between the City of <br /> <br /> <br />Redwood City and Sandpiper Lagoon Homeowners Association, <br /> <br />entitled "Quitclaim and Grant of Easement Agreement", which is <br /> <br />now on file in the office of the City Clerk. <br /> <br /> <br />3. That certain proposed agreement between the City of <br /> <br />Redwood City and Sandpiper Lagoon Homeowners Association, <br /> <br />entitled "Quitclaim and Grant of Easement Agreement", a copy of <br /> <br /> <br />which is on file in the office of the City Clerk and to which <br /> <br /> <br />reference is hereby made for the full particulars thereof, is <br /> <br /> <br />hereby approved, and the City manager is hereby authorized and <br /> <br />2 <br /> <br />10953 <br />
