<br />DES:d <br /> <br />03/22/89 (037/24) <br /> <br />OHIGINAl <br /> <br />---------- <br /> <br />RES 0 L UTI 0 N <br /> <br />NO.~ <br /> <br />MAR 2. 7 1989 <br /> <br />RESOLUTION RESCINDING AUTHORITY TO EXECUTE AGREEMENT <br />FOR ALLOCATING SEWERAGE TREATMENT CAPACITY AND <br />PROVIDING FOR MAINTENANCE AND REPAIR OF SEWER SYSTEM <br />RELATING TO FOX HOLLOW SUBDIVISION <br /> <br />WHEREAS, pursuant to Resolution No. 10820 adopted July ll, <br /> <br />1988 by this Council the City Manager was authorized and directed <br /> <br />to execute an agreement by and among the City of Redwood City, <br /> <br />the County of San Mateo, the Emerald Lake Heights Sewer <br /> <br />Maintenance District, and the Fox Hollow Homeowners Association, <br /> <br />a California nonprofit mutual benefit <br /> <br />corporation, <br /> <br />which <br /> <br />Agreement was executed as of July 14, 1988 (the "Agreement"); and <br /> <br />WHEREAS, the Agreement relates to the provision of sanitary <br /> <br />sewerage treatment capacity and facilities to serve the Fox <br /> <br />Hollow Subdivision located in the City of Redwood City, <br /> <br />California; and <br /> <br />WHEREAS, the need for the Agreement was predicated upon the <br /> <br />inability of the developer of the aforesaid subdivision to <br /> <br />acquire property rights necessary to cause the sanitary sewerage <br /> <br />system of said Subdivision to be connected directly to the <br /> <br />sanitary sewerage collection and transmission system of the City <br /> <br />of Redwood City; and <br /> <br />WHEREAS, subsequent to entering into said Agreement, the <br /> <br />developer of said Subdivision has acquired the aforesaid <br /> <br />necessary property rights; and <br /> <br />WHEREAS, there is no longer a need for the sanitary sewerage <br /> <br />treatment capacity allocation and facilities as provided under <br /> <br />the Agreement; <br /> <br />11007 <br />
